{"id":8559,"date":"2021-07-28T11:20:48","date_gmt":"2021-07-28T14:20:48","guid":{"rendered":"http:\/\/alcantara.pro.br\/portal\/?p=8559"},"modified":"2023-09-28T16:22:58","modified_gmt":"2023-09-28T16:22:58","slug":"bacen-ajusta-a-regulamentacao-sobre-prevencao-a-lavagem-de-dinheiro","status":"publish","type":"post","link":"https:\/\/alcantara.pro.br\/portal\/2021\/07\/28\/bacen-ajusta-a-regulamentacao-sobre-prevencao-a-lavagem-de-dinheiro\/","title":{"rendered":"BACEN ajusta a regulamenta\u00e7\u00e3o sobre preven\u00e7\u00e3o \u00e0 lavagem de dinheiro"},"content":{"rendered":"<div>O Banco Central do Brasil publicou, nesta data, [27.07.2021]\u00a0 a <a href=\"https:\/\/www.bcb.gov.br\/estabilidadefinanceira\/exibenormativo?tipo=Resolu%C3%A7%C3%A3o%20BCB&amp;numero=119\" target=\"_blank\" rel=\"noopener\">Resolu\u00e7\u00e3o BCB n\u00ba 119<\/a>, que promove ajustes pontuais na Circular n\u00ba 3.978, de 23 de janeiro de 2020, que trata da preven\u00e7\u00e3o \u00e0 lavagem de dinheiro e ao financiamento do terrorismo no \u00e2mbito do sistema financeiro.<\/div>\n<div><\/div>\n<div>A necessidade desses ajustes, descritos abaixo, decorre de aperfei\u00e7oamento, adequa\u00e7\u00e3o de casos espec\u00edficos e alinhamento \u00e0 norma de valores mobili\u00e1rios.<\/div>\n<ul>\n<li>Obten\u00e7\u00e3o da informa\u00e7\u00e3o do local de resid\u00eancia do cliente, no caso de pessoa natural, ou do local da sede ou filial, no caso de pessoa jur\u00eddica, passa a ser exigida nos procedimentos de qualifica\u00e7\u00e3o do cliente. Com isso, conforme previsto na regulamenta\u00e7\u00e3o para a etapa de qualifica\u00e7\u00e3o, a necessidade de verifica\u00e7\u00e3o e de valida\u00e7\u00e3o das informa\u00e7\u00f5es de localiza\u00e7\u00e3o do cliente, fornecida por ele, dever\u00e1 ser avaliada pelas institui\u00e7\u00f5es de acordo com o perfil de risco do cliente e com a natureza da rela\u00e7\u00e3o de neg\u00f3cio, tendo em vista a abordagem com base no risco.<\/li>\n<li>No caso da identifica\u00e7\u00e3o do benefici\u00e1rio final, e tendo em vista harmonizar a regulamenta\u00e7\u00e3o de compet\u00eancia do Banco Central com a regulamenta\u00e7\u00e3o da Comiss\u00e3o de Valores Mobili\u00e1rios (CVM) relativa a fundos de investimento e a investidores n\u00e3o residentes foram incorporados pela norma os fundos e clubes de investimento, os fundos de investimento constitu\u00eddos na forma de condom\u00ednio fechado e determinados investidores n\u00e3o residentes.<\/li>\n<li>Por fim, no caso de opera\u00e7\u00f5es com a utiliza\u00e7\u00e3o de recursos em esp\u00e9cie realizadas atrav\u00e9s de empresa de transporte de valores, a empresa transportadora passa a ser considerada a portadora dos recursos e ser\u00e1 identificada por meio do registro do n\u00famero de inscri\u00e7\u00e3o no CNPJ e da firma ou denomina\u00e7\u00e3o social.<\/li>\n<\/ul>\n<p>Fonte: <a href=\"https:\/\/www.bcb.gov.br\/detalhenoticia\/17454\/nota\" target=\"_blank\" rel=\"noopener\"><strong>Banco Central<\/strong><\/a>\u00a0| 27.07.2021<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>O Banco Central do Brasil publicou, nesta data, [27.07.2021]\u00a0 a Resolu\u00e7\u00e3o BCB n\u00ba 119, que<\/p>\n","protected":false},"author":1,"featured_media":10561,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[16,56,102,103,178],"tags":[],"class_list":["post-8559","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-auditoria-contabil-tributaria","category-c49-crimes-tributarios","category-fraudes","category-fraudes-corporativas","category-sigilo-bancario-fiscal"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
