{"id":6447,"date":"2019-02-01T09:35:39","date_gmt":"2019-02-01T12:35:39","guid":{"rendered":"http:\/\/alcantara.pro.br\/portal\/?p=6447"},"modified":"2019-02-01T09:35:39","modified_gmt":"2019-02-01T12:35:39","slug":"operacoes-com-cartao-de-credito-debito-e-alvo-de-acao-movida-pelo-mp-goias","status":"publish","type":"post","link":"https:\/\/alcantara.pro.br\/portal\/2019\/02\/01\/operacoes-com-cartao-de-credito-debito-e-alvo-de-acao-movida-pelo-mp-goias\/","title":{"rendered":"Opera\u00e7\u00f5es com  cart\u00e3o de cr\u00e9dito\/d\u00e9bito \u00e9 alvo de a\u00e7\u00e3o movida pelo MP Goi\u00e1s"},"content":{"rendered":"<p><a href=\"http:\/\/alcantara.pro.br\/portal\/wp-content\/uploads\/2019\/02\/caixa-registradora-pagamento.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-6448 alignright\" src=\"http:\/\/alcantara.pro.br\/portal\/wp-content\/uploads\/2019\/02\/caixa-registradora-pagamento-300x199.jpeg\" alt=\"\" width=\"300\" height=\"199\" \/><\/a><\/p>\n<p><strong>Empres\u00e1ria \u00e9 condenada por crime contra a ordem tribut\u00e1ria em a\u00e7\u00e3o movida pelo MP-GO.<\/strong><\/p>\n<p>Em a\u00e7\u00e3o penal promovida pelo Minist\u00e9rio P\u00fablico de Goi\u00e1s, a empres\u00e1ria Jaciara Cunha da Rocha foi condenada tr\u00eas anos e quatro meses de reclus\u00e3o pela pr\u00e1tica de crime contra a ordem tribut\u00e1ria, conforme o artigo 1\u00ba, incisos I e II, da Lei n\u00b0 8.137\/90, que fixam as condutas de omiss\u00e3o de informa\u00e7\u00e3o e fraude \u00e0 fiscaliza\u00e7\u00e3o.<\/p>\n<p>O juiz Ricardo Prata, da 8\u00aa Vara Criminal, reconheceu que Jaciara, na condi\u00e7\u00e3o de gestora da empresa Nunes &amp; Rocha Ltda, conhecida no mercado como Angelical Baby, em Goi\u00e2nia, fraudou a fiscaliza\u00e7\u00e3o tribut\u00e1ria e suprimiu Imposto sobre Circula\u00e7\u00e3o de Mercadorias e Servi\u00e7os (ICMS) em 44 meses, nos quais deixou de declarar opera\u00e7\u00f5es de vendas em que os recebimentos foram efetuados por cart\u00e3o de cr\u00e9dito\/d\u00e9bito.<\/p>\n<p>Considerando que as operadoras de cart\u00f5es informam \u00e0s autoridades fazend\u00e1rias suas pr\u00f3prias opera\u00e7\u00f5es, as omiss\u00f5es ocorridas nesse caso foram provadas pelo cruzamento das informa\u00e7\u00f5es.<\/p>\n<p>A sentenciada tamb\u00e9m foi condenada a pagar multa e a reparar os danos causados aos cofres p\u00fablicos, fixados em R$ 101.961,62, valor que dever\u00e1 ser atualizado. De acordo com o MP, a pena n\u00e3o foi maior porque houve confiss\u00e3o e foi aplicado o benef\u00edcio da continuidade delitiva.
