\"\"<\/a>J\u00e1 est\u00e1 dispon\u00edvel no site da Receita Federal a Consulta P\u00fablica n\u00ba 6<\/a>, de 2018, que trata de cria\u00e7\u00e3o de obriga\u00e7\u00e3o acess\u00f3ria para que as exchanges de criptoativos (empresas que negociam e\/ou viabilizam as opera\u00e7\u00f5es de compra e venda de criptoativos) prestem informa\u00e7\u00f5es de interesse da Receita Federal do Brasil relativas \u00e0s opera\u00e7\u00f5es envolvendo criptoativos, al\u00e9m de prever a declara\u00e7\u00e3o por parte de pessoas f\u00edsicas e jur\u00eddicas quando utilizarem exchanges no exterior ou n\u00e3o utilizarem ambientes disponibilizados por exchanges para as transa\u00e7\u00f5es envolvendo criptoativos.<\/p>\n

Observa-se, no Brasil, um aumento significativo do mercado de criptoativos nos \u00faltimos anos, o que demonstra a relev\u00e2ncia do mercado de criptoativos no Pa\u00eds, principalmente para a administra\u00e7\u00e3o tribut\u00e1ria, tendo em vista que as opera\u00e7\u00f5es est\u00e3o sujeitas \u00e0 incid\u00eancia do imposto de renda sobre o ganho de capital porventura auferido.<\/p>\n

Ademais, tem sido noticiado pela m\u00eddia a utiliza\u00e7\u00e3o de criptoativos em opera\u00e7\u00f5es de sonega\u00e7\u00e3o, de corrup\u00e7\u00e3o e de lavagem de dinheiro, n\u00e3o somente mundo afora, mas tamb\u00e9m no Brasil. A busca de determinados agentes pelo anonimato, que se configura como um dos principais atrativos para o uso de determinados criptoativos, deve sempre ser combatida, inclusive pela autoridade tribut\u00e1ria, a fim de aumentar o risco da pr\u00e1tica criminosa.<\/p>\n

Quanto \u00e0s a\u00e7\u00f5es tomadas por outros pa\u00edses, \u00e9 poss\u00edvel citar o caso da Austr\u00e1lia, onde foi imposto \u00e0s exchanges obedi\u00eancia a normas de identifica\u00e7\u00e3o, mitiga\u00e7\u00e3o e combate \u00e0 lavagem de dinheiro e ao financiamento ao terrorismo.<\/p>\n

Dentro os principais pontos da norma, destacam-se a necessidade de identifica\u00e7\u00e3o das identidades dos clientes, a manuten\u00e7\u00e3o dos arquivos por sete anos e o repasse das opera\u00e7\u00f5es acima de determinado valor (U$$ 10.000,00) para o \u00f3rg\u00e3o respons\u00e1vel pelo combate \u00e0 lavagem de dinheiro.<\/p>\n

No caso da Coreia do Sul, em janeiro de 2017, o estado exigiu cobran\u00e7a de impostos das exchanges que totalizaram aproximadamente 24% das receitas auferidas e que, para poderem operar no territ\u00f3rio daquele pa\u00eds, seria necess\u00e1rio, por parte das exchanges, garantir que os fundos dos clientes fossem mantidos separadamente, confirmar a identidade dos usu\u00e1rios, estabelecer um sistema adequado de combate \u00e0 lavagem de dinheiro e aumentar a transpar\u00eancia divulgando detalhes da transa\u00e7\u00e3o ao p\u00fablico.<\/p>\n

Em rela\u00e7\u00e3o a Europa, a Comiss\u00e3o Europeia prop\u00f4s que as trocas de criptoativos e as carteiras digitais devem estar sujeitas a regulamenta\u00e7\u00e3o, a fim de evitar a evas\u00e3o fiscal.<\/p>\n

Nos Estados Unidos, a n\u00edvel estadual, Nova Iorque criou regime espec\u00edfico de licenciamento aplic\u00e1veis \u00e0s exchanges, enquanto o Texas aplica as leis e os regulamentos existentes para o setor financeiro.<\/p>\n

Dessa forma, a institui\u00e7\u00e3o dessa obriga\u00e7\u00e3o acess\u00f3ria, para que as exchanges prestem informa\u00e7\u00f5es relativas \u00e0s opera\u00e7\u00f5es de compra e venda de criptoativos, vai na linha de viabilizar a verifica\u00e7\u00e3o da conformidade tribut\u00e1ria, al\u00e9m de aumentar os insumos na luta pelo combate \u00e0 lavagem de dinheiro e corrup\u00e7\u00e3o, produzindo, tamb\u00e9m, um aumento da percep\u00e7\u00e3o de risco em rela\u00e7\u00e3o a contribuintes com inten\u00e7\u00e3o de evas\u00e3o fiscal.<\/p>\n
