{"id":6125,"date":"2018-08-27T06:00:30","date_gmt":"2018-08-27T09:00:30","guid":{"rendered":"http:\/\/alcantara.pro.br\/portal\/?p=6125"},"modified":"2018-08-27T06:00:30","modified_gmt":"2018-08-27T09:00:30","slug":"projeto-autoriza-instauracao-de-inventario-quando-herdeiros-do-espolio-nao-se-manifestam","status":"publish","type":"post","link":"https:\/\/alcantara.pro.br\/portal\/2018\/08\/27\/projeto-autoriza-instauracao-de-inventario-quando-herdeiros-do-espolio-nao-se-manifestam\/","title":{"rendered":"Projeto autoriza instaura\u00e7\u00e3o de invent\u00e1rio quando herdeiros do esp\u00f3lio n\u00e3o se manifestam"},"content":{"rendered":"<p><span style=\"font-family: arial, helvetica, sans-serif;\"><a href=\"http:\/\/alcantara.pro.br\/portal\/wp-content\/uploads\/2018\/08\/testamento.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-6126 alignright\" src=\"http:\/\/alcantara.pro.br\/portal\/wp-content\/uploads\/2018\/08\/testamento.jpg\" alt=\"\" width=\"282\" height=\"179\" \/><\/a>Projeto que disciplina o ajuizamento de a\u00e7\u00e3o contra esp\u00f3lio nos casos em que os herdeiros n\u00e3o tiverem instaurado o invent\u00e1rio no prazo legal tramita na Comiss\u00e3o de Constitui\u00e7\u00e3o, Justi\u00e7a e Cidadania (CCJ), onde aguarda designa\u00e7\u00e3o de relator.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;\">A proposta (<a class=\"external-link\" href=\"http:\/\/www25.senado.leg.br\/web\/atividade\/materias\/-\/materia\/133900\" target=\"_blank\" rel=\"noopener\">PLS 333\/2018<\/a>) determina que, transcorrido o prazo legal para a instaura\u00e7\u00e3o do invent\u00e1rio por herdeiros, ser\u00e1 permitida a representa\u00e7\u00e3o processual para que se possa, em 30 dias, regularizar a a\u00e7\u00e3o do esp\u00f3lio, instaurando-se o invent\u00e1rio com a nomea\u00e7\u00e3o de um inventariante.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;\">Em caso de desconhecimento de herdeiros por parte do autor da a\u00e7\u00e3o ou de tentativas frustradas de intima\u00e7\u00e3o nos endere\u00e7os indicados pelo autor, a cita\u00e7\u00e3o ou intima\u00e7\u00e3o de herdeiros poder\u00e1 ser feita por edital.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;\">\u201c\u00c9 comum situa\u00e7\u00f5es em que pessoas em processo de negocia\u00e7\u00e3o de im\u00f3veis com um propriet\u00e1rio que veio a falecer enfrentem grande dificuldade para concluir a compra e obter a propriedade do im\u00f3vel porque herdeiros n\u00e3o instauram o processo de invent\u00e1rio nem designam inventariante\u201d, explica o senador Fernando Bezerra Coelho (MDB-PE), autor da proposta.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;\">Pelo C\u00f3digo de Processo Civil (CPC), \u00e9 dever dos herdeiros instaurar o processo de invent\u00e1rio dentro do prazo de dois meses do falecimento.
