H\u00e1 in\u00fameras normas, que muitas vezes divergem entre estados e esferas de governo. Estudo exclusivo do professor do Ibmec-RJ Paulo Henrique P\u00eagas revela que, no ano passado, as 35 maiores empresas de capital aberto do pa\u00eds informaram, em seus balan\u00e7os cont\u00e1beis, que t\u00eam risco de perder at\u00e9 R$ 549 bilh\u00f5es em processos, administrativos e judiciais, referentes ao recolhimento de tributos.<\/p>\n<p style=\"text-align: justify;\">\u2014 Esse valor corresponde a 42% do patrim\u00f4nio l\u00edquido dessas empresas. Mesmo que parte desses processos seja classificada de perda remota, o valor \u00e9 t\u00e3o grande que, se uma empresa perder um ter\u00e7o das causas, pode quebrar. O problema n\u00e3o \u00e9 o tamanho da carga tribut\u00e1ria, \u00e9 n\u00e3o saber se est\u00e1 certa a forma como o imposto est\u00e1 sendo recolhido \u2014 diz P\u00eagas.<\/p>\n<p style=\"text-align: justify;\">O levantamento mostra que, quando se exclui os bancos, as disputas fiscais das empresas n\u00e3o financeiras ocupam um espa\u00e7o ainda maior do patrim\u00f4nio l\u00edquido: 55%, com d\u00edvida total de R$ 454 bilh\u00f5es. O maior patamar \u00e9 observado no setor de telecomunica\u00e7\u00f5es. Os processos correspondem a 77%, em m\u00e9dia, do patrim\u00f4nio l\u00edquido.<\/p>\n<p style=\"text-align: justify;\">\u2014 Em empresas multinacionais, \u00e9 impressionante como os balan\u00e7os mostram os processos concentrados no Brasil. L\u00e1 fora, n\u00e3o h\u00e1 esse contencioso t\u00e3o grande \u2014 observa P\u00eagas.<\/p>\n<p style=\"text-align: justify;\">O risco trabalhista, sempre citado como uma dos maiores preocupa\u00e7\u00f5es das empresas, \u00e9 bem inferior, de acordo com as informa\u00e7\u00f5es contidas nos balan\u00e7os e formul\u00e1rios de refer\u00eancia enviados \u00e0 Comiss\u00e3o de Valores Mobili\u00e1rios (CVM, o \u00f3rg\u00e3o regulador do mercado de capitais).
