Enquanto essa decis\u00e3o n\u00e3o sai, qualquer pessoa pode procurar um advogado ou a Defensoria P\u00fablica se quiser mover uma a\u00e7\u00e3o sobre o assunto, usando os mesmos fundamentos:<\/p>\n<p style=\"text-align: justify;\">\u2014 Os valores n\u00e3o correspondem \u00e0 infla\u00e7\u00e3o do per\u00edodo. Isso fere os princ\u00edpios constitucionais da capacidade contribuitiva, do n\u00e3o confisco e da dignidade da pessoa humana.<\/p>\n<p style=\"text-align: justify;\">Leonardo lembra que, caso a OAB consiga a a\u00e7\u00e3o, o resultado ser\u00e1 v\u00e1lido para todos. Mas ele pondera que o caminho deve ser longo.<\/p>\n<p style=\"text-align: justify;\">\u2014 A a\u00e7\u00e3o da OAB pedia liminar, que foi negada. Mas o julgamento final ainda n\u00e3o aconteceu. \u00c9 um caso dif\u00edcil porque o Judici\u00e1rio n\u00e3o pode escolher um \u00edndice.<\/p>\n<p style=\"text-align: justify;\">Se o STF considerar procedente a a\u00e7\u00e3o da OAB Nacional, Leonardo Ribeiro Pessoa, professor de Direito Empresarial e Tribut\u00e1rio do Ibmec Rio, lembra que a corre\u00e7\u00e3o ser\u00e1 aplicada para todos os contribuintes prejudicados pela defasagem acumulada: \u201cO contribuinte deve guardar as declara\u00e7\u00f5es enviadas para a Receita e os documentos relacionados \u00e0s despesas\u201d. Segundo o professor, n\u00e3o h\u00e1 previs\u00e3o para julgamento: \u201cPode ser que demore mais tr\u00eas ou quatro anos, mas poder\u00e1 ter um efeito retroativo.
