{"id":4676,"date":"2016-10-10T05:00:32","date_gmt":"2016-10-10T08:00:32","guid":{"rendered":"http:\/\/alcantara.pro.br\/portal\/?p=4676"},"modified":"2016-10-10T05:00:32","modified_gmt":"2016-10-10T08:00:32","slug":"riscos-nos-erros-de-informacao-da-ncm-nas-notas-fiscais","status":"publish","type":"post","link":"https:\/\/alcantara.pro.br\/portal\/2016\/10\/10\/riscos-nos-erros-de-informacao-da-ncm-nas-notas-fiscais\/","title":{"rendered":"Riscos nos erros de informa\u00e7\u00e3o da NCM nas notas fiscais"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Quais os riscos de n\u00e3o preencher corretamente a NCM nas notas fiscais<\/strong><\/p>\n<p style=\"text-align: justify;\">A NCM (Nomenclatura Comum do Mercosul) \u00e9 um dos tantos dados presentes em uma Nota Fiscal brasileira, mas, assim como muitas outras informa\u00e7\u00f5es do documento, a NCM passa despercebida aos olhos, n\u00e3o s\u00f3 do usu\u00e1rio, mas tamb\u00e9m do contribuinte.<\/p>\n<p>\u00c9 importante que, principalmente quem emitem uma NF, saiba seu significado e sua import\u00e2ncia. Afinal, ela est\u00e1 na nota fiscal por um motivo muito relevante.<\/p>\n<p>A NCM \u00e9 um c\u00f3digo estabelecido pelo governo brasileiro para identificar e controlar mercadorias importadas ou compradas no Brasil, para ent\u00e3o, serem tributadas nas transa\u00e7\u00f5es.<\/p>\n<p style=\"text-align: justify;\">O c\u00f3digo \u00e9 adotado pelos pa\u00edses membros do Mercosul desde janeiro de 1995, e trata-se de um n\u00famero de 8 d\u00edgitos que deve constar em toda documenta\u00e7\u00e3o legal, seja notas fiscais ou livros legais. S\u00f3 assim a mercadoria pode ser classificada de acordo com os regulamentos do Mercosul. Os 6 primeiros d\u00edgitos representam a classifica\u00e7\u00e3o SH (Sistema Harmonizado), que \u00e9 um m\u00e9todo internacional de classifica\u00e7\u00e3o de mercadorias que cont\u00e9m uma estrutura de c\u00f3digos com a descri\u00e7\u00e3o de caracter\u00edsticas espec\u00edficas dos produtos. E os outros 2 \u00faltimos s\u00e3o parte de especifica\u00e7\u00f5es do pr\u00f3prio Mercosul.<\/p>\n<p style=\"text-align: justify;\">No Brasil, o \u00f3rg\u00e3o respons\u00e1vel \u00e9 a Secretaria da Receita Federal que desde 2000 monitora mercadorias brasileiras. Se a NCM n\u00e3o for preenchida corretamente pode gerar uma s\u00e9rie de problemas e multas que, al\u00e9m de atrasar contribuintes e usu\u00e1rios, tamb\u00e9m pode causar a perda de benef\u00edcios fiscais ou a aplica\u00e7\u00e3o da substitui\u00e7\u00e3o tribut\u00e1ria, redu\u00e7\u00e3o e isen\u00e7\u00e3o, que o Fisco Estadual concede ap\u00f3s a correta identifica\u00e7\u00e3o da NCM.<\/p>\n<p style=\"text-align: justify;\"><strong>Os principais erros cometidos na NCM<\/strong><\/p>\n<p style=\"text-align: justify;\">O maior erro das empresas \u00e9 classificar de maneira tendenciosa suas mercadorias para escapar do regime de substitui\u00e7\u00e3o tribut\u00e1ria ou para ter uma margem de valor agregado menor. Nesses casos, a multa pode chegar a 1% do seu valor.<\/p>\n<p>Outro erro est\u00e1 relacionado \u00e0s al\u00edquotas de tributos incidentes na comercializa\u00e7\u00e3o e circula\u00e7\u00e3o desses produtos, que pode incluir IPI (Imposto sobre Produtos Industrializados), II (Imposto de Importa\u00e7\u00e3o) e Imposto sobre Circula\u00e7\u00e3o de Mercadorias e Servi\u00e7os (ICMS). A mercadoria pode ficar presa na alf\u00e2ndega ou at\u00e9 mesmo ser devolvida ao pa\u00eds de origem.<\/p>\n<p><strong>Multas<\/strong><\/p>\n<p>Informa\u00e7\u00e3o incorreta de NCM ou aus\u00eancia na BL (Conhecimento de Embarque) pode incorrer em multa de R$ 5.000,00.<\/p>\n<p>J\u00e1 quando a NCM est\u00e1 incorreta na LI (Licen\u00e7a de Importa\u00e7\u00e3o) e na descri\u00e7\u00e3o, a multa pode ser de 15% sobre o valor da mercadoria mais 1% por causa da classifica\u00e7\u00e3o incorreta.<\/p>\n<p>Al\u00e9m disso, se houver necessidade de fazer uma nova LI depois do embarque, a multa pode variar entre R$ 2.500,00 e R$ 5.000,00, se a empresa n\u00e3o informar o erro.<\/p>\n<p><strong>NCM incorreto<\/strong><\/p>\n<p>Quem receber uma mercadoria com c\u00f3digo incorreto dever\u00e1 passar para seu fornecedor o c\u00f3digo correto, sob pena de ser autuado caso n\u00e3o fa\u00e7a.
