O c\u00f3digo NCM (Nomenclatura Comum do Mercosul) \u00e9 formado por 8 d\u00edgitos e imposto pelo governo brasileiro como forma de controlar e identificar os produtos a serem tributados nas transa\u00e7\u00f5es.<\/span><\/p>\n<p><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\">A obrigatoriedade do SPED Fiscal (EFD) levou muitas ind\u00fastrias e empreendimentos equiparados, distribuidores e atacadistas a classificar ou reclassificar o c\u00f3digo, optando por menores al\u00edquotas do Imposto sobre Industrializa\u00e7\u00e3o (IPI). Contudo, os erros mais comuns s\u00e3o os seguintes:<\/span><\/p>\n<ul>\n<li><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\">Informa\u00e7\u00e3o incorreta de NCM ou aus\u00eancia na BL (Bill of Landing, documenta\u00e7\u00e3o cuja tradu\u00e7\u00e3o literal significa Conhecimento de Embarque): pode incorrer em multa de R$ 5.000,00;<\/span><\/li>\n<li><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\">NCM incorreto na LI (Licen\u00e7a de Importa\u00e7\u00e3o) e descri\u00e7\u00e3o incorreta: pode causar multa de 15% sobre o valor da mercadoria mais 1% por causa da classifica\u00e7\u00e3o incorreta.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\">Al\u00e9m disso, se houver necessidade de fazer uma nova LI depois do embarque, a multa pode variar entre R$ 2.500,00 e R$ 5.000,00, se a empresa n\u00e3o informar o erro.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Regra_de_validacao_105-20\"><\/span><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\"><strong>Regra de valida\u00e7\u00e3o 105-20<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\">A Nota T\u00e9cnica da NF-e 2015\/002 apresenta a regra de valida\u00e7\u00e3o 105-20. Essa regra vai verificar se o NCM informado na nota fiscal \u00e9 v\u00e1lido, constando na tabela de NCM publicada pelo Minist\u00e9rio do Desenvolvimento (MDIC). A regra de valida\u00e7\u00e3o 105-20 aplica-se, em produ\u00e7\u00e3o, para as notas fiscais emitidas a partir de 01\/01\/2016. A exce\u00e7\u00e3o \u00e9 que essa regra n\u00e3o se aplica, em produ\u00e7\u00e3o, \u00e0s notas fiscais emitidas antes do dia 01\/01\/2016.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Codigo_zerado_NCM\"><\/span><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\"><strong>C\u00f3digo zerado NCM<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\">Vale considerar os casos em que o c\u00f3digo \u00e9 preenchido completamente por zeros. Isso ocorre quando o item da\u00a0<a href=\"http:\/\/br.sageone.com\/\">nota fiscal<\/a>\u00a0refere-se a servi\u00e7os tributados pelo ISS (Imposto sobre Servi\u00e7os de Qualquer Natureza) ou quando a nota \u00e9 de ajuste. Notas complementares que se relacionem a um dos casos citados tamb\u00e9m devem ser preenchidas por zeros no campo correspondente.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"NCM_incorreto_como_proceder\"><\/span><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\">NCM incorreto: como proceder<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\">O comerciante que receber um produto com c\u00f3digo incorreto dever\u00e1 passar para seu fornecedor o c\u00f3digo correto, caso contr\u00e1rio poder\u00e1 ser autuado. Se for constatado o erro na codifica\u00e7\u00e3o, o Fisco vai verificar os lan\u00e7amentos do passado e poder\u00e1 ser cobrada a\u00a0<a href=\"http:\/\/blog.sage.com.br\/calculo-do-diferencial-de-aliquota-o-que-e-e-como-funciona\/\">diferen\u00e7a de al\u00edquota<\/a>, com as multas e juros relacionados.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Medidas_preventivas\"><\/span><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\">Medidas preventivas<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\">Para evitar problemas com o Fisco, \u00e9 importante atualizar a base cadastral em rela\u00e7\u00e3o aos c\u00f3digos NCM que a empresa utiliza. Com um NCM inexistente, a\u00a0<a href=\"http:\/\/br.sageone.com\/\">nota fiscal<\/a>\u00a0ser\u00e1 rejeitada. A par da revis\u00e3o dos c\u00f3digos NCM, \u00e9 importante verificar o enquadramento correto dos itens. O \u00f3rg\u00e3o respons\u00e1vel para consultas sobre classifica\u00e7\u00e3o de mercadorias, que pode apresentar solu\u00e7\u00f5es para as d\u00favidas e problemas, \u00e9 a Receita Federal do Brasil (RFB) por meio da Coordena\u00e7\u00e3o Geral do Sistema Aduaneiro e da Superintend\u00eancia Regional.<\/span><\/p>\n<p><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\">Outra recomenda\u00e7\u00e3o \u00e9 que as empresas revisem ainda os cadastros de clientes e fornecedores, confirmando se o endere\u00e7o deles \u00e9 o mesmo que consta no cadastro do Fisco Federal ou Estadual. A empresa deve pedir comprova\u00e7\u00e3o por laudo ou documentos t\u00e9cnicos de profissionais da \u00e1rea.<\/span><\/p>\n<p><span style=\"font-size: 14px; font-family: arial, helvetica, sans-serif;\">E voc\u00ea, j\u00e1 se previne contra estes erros?
