{"id":3345,"date":"2015-11-16T09:46:50","date_gmt":"2015-11-16T12:46:50","guid":{"rendered":"http:\/\/alcantara.pro.br\/portal\/?p=3345"},"modified":"2015-11-16T09:46:50","modified_gmt":"2015-11-16T12:46:50","slug":"peso-das-multas-tributarias-em-julgamento-no-stf","status":"publish","type":"post","link":"https:\/\/alcantara.pro.br\/portal\/2015\/11\/16\/peso-das-multas-tributarias-em-julgamento-no-stf\/","title":{"rendered":"Peso das multas tribut\u00e1rias em julgamento no STF"},"content":{"rendered":"<p style=\"text-align: justify;\"><b>STF julgar\u00e1 se multa fiscal por sonega\u00e7\u00e3o tem car\u00e1ter confiscat\u00f3rio<\/b><\/p>\n<p>O Supremo Tribunal Federal (STF) reconheceu a repercuss\u00e3o geral da mat\u00e9ria tratada no Recurso Extraordin\u00e1rio (RE) 736090, no qual se discute se a multa de 150% aplicada pela Receita Federal em raz\u00e3o de sonega\u00e7\u00e3o, fraude ou conluio tem car\u00e1ter confiscat\u00f3rio. No caso concreto, trata-se da aplica\u00e7\u00e3o da multa em um caso de separa\u00e7\u00e3o de empresas de um mesmo grupo econ\u00f4mico, com finalidade de n\u00e3o pagar impostos, entendida como sonega\u00e7\u00e3o pela Receita Federal.<\/p>\n<p>O recurso questiona decis\u00e3o do Tribunal Regional Federal\u00a0da 4\u00aa Regi\u00e3o\u00a0(TRF-4) que entendeu v\u00e1lida a multa no percentual de 150%, nos termos da Lei 9.430\/1996. Sustenta que o ac\u00f3rd\u00e3o violou o artigo 150, IV, da Constitui\u00e7\u00e3o Federal, que veda a utiliza\u00e7\u00e3o de tributo com efeito de confisco.<\/p>\n<p>\u201cCabe a esta Corte, portanto, em aten\u00e7\u00e3o ao princ\u00edpio da seguran\u00e7a jur\u00eddica e tendo em vista a necessidade de concretiza\u00e7\u00e3o da norma constitucional que veda o confisco na seara tribut\u00e1ria, fixar, no regime da repercuss\u00e3o geral, as balizas para a aferi\u00e7\u00e3o da exist\u00eancia de efeito confiscat\u00f3rio na aplica\u00e7\u00e3o de multas fiscais qualificadas\u201d, afirmou o relator do recurso, ministro Luiz Fux. Em sua manifesta\u00e7\u00e3o, entendeu que a quest\u00e3o tem natureza constitucional relevante dos pontos de vista econ\u00f4mico e jur\u00eddico que transcende os interesses das partes envolvidas, \u201cpois alcan\u00e7a potencialmente todos os entes federativos e contribuintes\u201d.<\/p>\n<p>O ministro mencionou precedentes em que o pr\u00f3prio STF considerou confiscat\u00f3rias, \u201csob uma \u00f3tica abstrata\u201d, multas fiscais fixadas em montantes desproporcionais \u00e0 conduta do contribuinte, especialmente quando ultrapassam o valor do tributo devido. Ele tamb\u00e9m ressaltou que o tema n\u00e3o se confunde com o apreciado no RE 640452, tamb\u00e9m com repercuss\u00e3o geral reconhecida, no qual se discute a multa por descumprimento de obriga\u00e7\u00e3o acess\u00f3ria.<\/p>\n<p>\u201cDiscute-se, na esp\u00e9cie, a razoabilidade da multa fiscal qualificada em raz\u00e3o de sonega\u00e7\u00e3o, fraude ou conluio, no percentual de 150% sobre a totalidade ou diferen\u00e7a do imposto ou contribui\u00e7\u00e3o n\u00e3o paga, n\u00e3o recolhida, n\u00e3o declarada ou declarada de forma inexata\u201d, afirmou o relator ao se manifestar pelo reconhecimento de repercuss\u00e3o geral. Seu entendimento foi seguido, por maioria, em delibera\u00e7\u00e3o no Plen\u00e1rio Virtual da Corte.<\/p>\n<p><b>Caso<\/b><\/p>\n<p>O processo discutir\u00e1 o caso de um posto de combust\u00edvel localizado em Cambori\u00fa (SC), multado pela Receita Federal no percentual de 150% sob o entendimento de que ele compunha um grupo econ\u00f4mico com outras empresas e postos.
