O Estado da Bahia instituiu atrav\u00e9s da pela Lei 13.449\/2015 (Di\u00e1rio Oficial de 22\/10\/2015) o Programa de Transa\u00e7\u00e3o Judicial e Extrajudicial de\u00a0 Cr\u00e9ditos\u00a0 Tribut\u00e1rios\u00a0 –\u00a0 Programa\u00a0 CONCILIA\u00a0 BAHIA, tendo\u00a0 por\u00a0 objetivo\u00a0 principal\u00a0 a\u00a0 redu\u00e7\u00e3o\u00a0 do acervo\u00a0 de\u00a0 processos\u00a0 das\u00a0 Varas\u00a0 da Fazenda P\u00fablica, com a consequente recupera\u00e7\u00e3o de cr\u00e9ditos tribut\u00e1rios.<\/p>\n

O\u00a0 Programa\u00a0 CONCILIA\u00a0 BAHIA\u00a0 ser\u00e1\u00a0 implementado\u00a0 no\u00a0 per\u00edodo de 03\/11 a 18\/12 de 2015, cabendo ao Tribunal de Justi\u00e7a do Estado da Bahia a fixa\u00e7\u00e3o do per\u00edodo para\u00a0 realiza\u00e7\u00e3o de mutir\u00e3o de negocia\u00e7\u00e3o\u00a0 e o agendamento das audi\u00eancias de concilia\u00e7\u00e3o.<\/p>\n

O Tribunal de Justi\u00e7a da Bahia, o Governo do Estado e a Prefeitura de Salvador promovem, de 3 a 8 de novembro, um mutir\u00e3o de negocia\u00e7\u00e3o fiscal para quita\u00e7\u00e3o de d\u00edvidas estaduais e municipais.As mesas de negocia\u00e7\u00e3o ser\u00e3o instaladas na Arena Fonte Nova, com a participa\u00e7\u00e3o de ju\u00edzes leigos e conciliadores. A iniciativa atende ao Programa Nacional de Governan\u00e7a Diferenciada das Execu\u00e7\u00f5es Fiscais, de iniciativa da Corregedoria Nacional de Justi\u00e7a.<\/em><\/span><\/p>\n

O mutir\u00e3o, denominado Acordo Legal, prev\u00ea descontos de at\u00e9 100% – nas d\u00edvidas com o Munic\u00edpio – sobre os juros e as multas. O trabalho ser\u00e1 realizado no dia 3, das 8 \u00e0s 14 horas, e nos dias seguintes, at\u00e9 dia 8, entre 8 e 19 horas.<\/em><\/span><\/p>\n

O cidad\u00e3o ou sua empresa pode pagar d\u00edvidas de impostos como ICMS, IPVA, IPTU e ISS. A negocia\u00e7\u00e3o implica na conquista de novos prazos.<\/em><\/span><\/p>\n

O objetivo do programa \u00e9 reduzir o estoque de processos referentes \u00e0 execu\u00e7\u00e3o fiscal em tr\u00e2mite no Judici\u00e1rio, aprimorando a governan\u00e7a nas varas por meio da gest\u00e3o estrat\u00e9gica dos processos, viabilizar o aumento da arrecada\u00e7\u00e3o e promover a cidadania tribut\u00e1ria, incentivando a popula\u00e7\u00e3o a manter sua situa\u00e7\u00e3o fiscal em dia.<\/em><\/span><\/p>\n

Os mutir\u00f5es realizados em Mato Grosso, Pernambuco, Rio de Janeiro e no Distrito Federal arrecadaram R$ 3,3 bilh\u00e3o e resultaram em mais de 100 mil processos baixados, de acordo com a Corregedoria Nacional de Justi\u00e7a.<\/em><\/span><\/p>\n

A corregedora Nacional de Justi\u00e7a, ministra Nancy Andrighi exaltou a uni\u00e3o dos \u00f3rg\u00e3os p\u00fablicos no Rio para viabilizar o Mutir\u00e3o de Negocia\u00e7\u00e3o Fiscal. \u201cQuando os Poderes se unem para realizar um trabalho igual a esse, o resultado \u00e9 muito bom para todos\u201d, ressaltou.<\/em><\/span><\/p>\n

D\u00edvidas com o Estado<\/b><\/em><\/span><\/p>\n

Ap\u00f3s o mutir\u00e3o, o Estado manter\u00e1 a possibilidade de renegocia\u00e7\u00e3o, com o programa Concilia Bahia, mas em hor\u00e1rios e locais diferentes, at\u00e9 18 de dezembro.<\/em><\/span><\/p>\n

Para os d\u00e9bitos do ICM e ICMS, a redu\u00e7\u00e3o prevista \u00e9 de 85% na multa por infra\u00e7\u00e3o e nos acr\u00e9scimos quando o pagamento for feito integralmente, \u00e0 vista. O desconto ser\u00e1 de 60% para quem fizer o parcelamento em at\u00e9 36 meses, e de 25% para parcelamento em at\u00e9 48 meses.<\/em><\/span><\/p>\n

Para os d\u00e9bitos de IPVA, ITD e taxas, os descontos em multas e acr\u00e9scimos ser\u00e3o os seguintes: 85% para pagamento integral \u00e0 vista, e 60% para parcelamento em at\u00e9 quatro meses. O valor de cada parcela dever\u00e1 ser de no m\u00ednimo R$ 200.<\/em><\/span><\/p>\n

D\u00e9bitos tribut\u00e1rios inscritos em d\u00edvida e n\u00e3o ajuizados poder\u00e3o ser contemplados por transa\u00e7\u00e3o extrajudicial, a ser realizada pela Procuradoria-Geral do Estado, com os mesmos percentuais de redu\u00e7\u00e3o de multas e acr\u00e9scimos previstos para as transa\u00e7\u00f5es judiciais. Tamb\u00e9m ter\u00e3o direito \u00e0s mesmas condi\u00e7\u00f5es os d\u00e9bitos tribut\u00e1rios denunciados ou lan\u00e7ados e n\u00e3o inscritos em d\u00edvida ativa, cujo fator gerador tenha ocorrido at\u00e9 31 de dezembro de 2014.<\/em><\/span><\/p>\n
