Execu\u00e7\u00e3o fiscal<\/span><\/span><\/b><\/span> – projeto apresentado pelo governo federal alterando a Lei de Execu\u00e7\u00e3o Fiscal (Lei n\u00ba 6.830\/80) vem gerando temor e protestos entre advogados, ju\u00edzes, tributaristas e contadores. Elaborado a partir de audi\u00eancia p\u00fablica realizada pelo Conselho de Justi\u00e7a Federal no final do ano passado, o projeto pretende agilizar a forma como \u00e9 feita a execu\u00e7\u00e3o fiscal transferindo para a compet\u00eancia do Poder Executivo determinados atos que hoje s\u00e3o realizados pelo Judici\u00e1rio. S\u00e3o os casos da penhora, notifica\u00e7\u00e3o do contribuinte, leil\u00e3o e arremata\u00e7\u00e3o dos bens do devedor. Sigilo<\/span><\/span><\/b><\/span> – a Comiss\u00e3o de Valores Mobili\u00e1rios (CVM) pretende enviar uma proposta ao Congresso para permitir a troca de informa\u00e7\u00f5es de sigilos banc\u00e1rios entre entidades fiscalizadoras. De acordo com a presidente da autarquia, Maria Helena Santana<\/st1:personname>, a quest\u00e3o est\u00e1 sendo discutida no \u00e2mbito do Comit\u00ea de Regula\u00e7\u00e3o e Fiscaliza\u00e7\u00e3o dos Mercados Financeiro, de Capitais, de Seguros, de Previd\u00eancia e Capitaliza\u00e7\u00e3o (Coremec). Fiscal<\/span><\/span><\/b><\/span> – a quebra de sigilo banc\u00e1rio regulamentada pela Receita Federal no in\u00edcio deste ano sofreu a primeira derrota, que se tem conhecimento, na primeira inst\u00e2ncia da Justi\u00e7a Federal. A 3\u00aa Vara Federal de Florian\u00f3polis, em Santa Catarina, concedeu senten\u00e7a favor\u00e1vel a um contribuinte, pessoa f\u00edsica, que se op\u00f4s ao envio de informa\u00e7\u00f5es de sua conta corrente ao fisco. Com o fim da CPMF, a Receita editou em janeiro a Instru\u00e7\u00e3o Normativa<\/st1:personname> n\u00ba 802 que obriga os bancos a informarem as movimenta\u00e7\u00f5es banc\u00e1rias de correntistas a cada seis meses. As Seccionais da Ordem dos Advogados do Brasil (OAB) do Cear\u00e1 e do Mato Grosso do Sul j\u00e1 obtiveram liminares suspendendo os efeitos da norma. Fiscal <\/span><\/span><\/b><\/span>– a Receita Federal aumentou a fiscaliza\u00e7\u00e3o do Imposto de Renda, por meio de filtros eletr\u00f4nicos, para detectar mais erros nas declara\u00e7\u00f5es deste ano. Joaquim Adir, supervisor nacional do IR, confirmou o aperto na fiscaliza\u00e7\u00e3o e disse que o objetivo \u00e9 que o n\u00famero de contribuintes retidos na malha fina seja menor do que o registrado nos anos anteriores. No entanto, para que a malha fina diminua, \u00e9 preciso que o contribuinte cheque a situa\u00e7\u00e3o da declara\u00e7\u00e3o no site da Receita (www.receita.fazenda.gov.br<\/a><\/span><\/span><\/u>, clique no \u00edcone “IRPF – Consulta declara\u00e7\u00f5es entregues e restitui\u00e7\u00e3o” no centro da p\u00e1gina e, em seguida, “Extrato simplificado do processamento”) e corrija os erros encontrados pelo fisco.
