A CVM emitiu nota no \u00faltimo dia 30.01 com esclarecimentos sobre a elabora\u00e7\u00e3o das Demonstra\u00e7\u00f5es Cont\u00e1beis de 2008, especificamente sobre a aplica\u00e7\u00e3o dos Pronunciamentos Cont\u00e1beis do CPC . Destaque especial para evidencia\u00e7\u00e3o de opera\u00e7\u00f5es com derivativos, alertando as empresas a n\u00e3o cometerem os mesmos desvios encontrados <\/a>em algumas ITR do 3 Trm\/2008.<\/p>\n

Prezados Senhores<\/p>\n

O presente Of\u00edcio-Circular tem como objetivo levar \u00e0s companhias abertas e aos respectivos auditores independentes esclarecimentos sobre alguns pontos dos Pronunciamentos do Comit\u00ea de Pronunciamentos Cont\u00e1beis \u2013 CPC aprovados por esta Comiss\u00e3o de Valores Mobili\u00e1rios.<\/p>\n

Diversas d\u00favidas e indaga\u00e7\u00f5es foram, em certos casos, trazidas \u00e0 Superintend\u00eancia de Normas Cont\u00e1beis e de Auditoria \u2013 SNC e, em outros, levadas ao pr\u00f3prio CPC. A partir de an\u00e1lise realizada em conjunto pela SNC e pelo CPC, foi emitida a Orienta\u00e7\u00e3o OCPC 02 \u2013 Esclarecimentos sobre as Demonstra\u00e7\u00f5es Cont\u00e1beis de 2008, que segue anexa a este Of\u00edcio e que est\u00e1 sendo endossada pelas Superintend\u00eancias de Rela\u00e7\u00f5es com Empresas – SEP e de Normas Cont\u00e1beis e de Auditoria – SNC.<\/p>\n

Cabe ressaltar que a ado\u00e7\u00e3o dos tratamentos excepcionais referidos nos itens 18, 22 e 121 da Orienta\u00e7\u00e3o OCPC 02 deve ser objeto de expressa solicita\u00e7\u00e3o de autoriza\u00e7\u00e3o \u00e0 Comiss\u00e3o de Valores Mobili\u00e1rios, e dever\u00e1 estar acompanhada de exposi\u00e7\u00e3o detalhada sobre as raz\u00f5es que fundamentam o pedido de tratamento excepcional, al\u00e9m da manifesta\u00e7\u00e3o dos auditores independentes quanto \u00e0 sua pertin\u00eancia. A solicita\u00e7\u00e3o dever\u00e1 ser apresentada \u00e0 Superintend\u00eancia de Normas Cont\u00e1beis e de Auditoria com a anteced\u00eancia necess\u00e1ria para o seu exame, considerando, inclusive, que, em fun\u00e7\u00e3o da complexidade do pedido ou da insufici\u00eancia de dados na sua formula\u00e7\u00e3o ou fundamenta\u00e7\u00e3o, poder\u00e1 ser requerida a apresenta\u00e7\u00e3o de esclarecimentos e comprova\u00e7\u00f5es adicionais.

Finalmente, alertamos \u00e0s companhias abertas e aos auditores independentes sobre o adequado cumprimento da Instru\u00e7\u00e3o CVM n\u00ba 475, que, al\u00e9m de requerer informa\u00e7\u00f5es sobre os instrumentos financeiros como um todo, e n\u00e3o somente os derivativos, tornou obrigat\u00f3ria a divulga\u00e7\u00e3o do quadro demonstrativo de an\u00e1lise de sensibilidade. Este alerta decorre do trabalho de acompanhamento das informa\u00e7\u00f5es trimestrais de 30.09.2008, realizado pela CVM, em que foram observadas falhas no cumprimento integral da Delibera\u00e7\u00e3o CVM n\u00ba 550 e foi, por isso, determinado o refazimento de algumas ITRs e o aperfei\u00e7oamento de outras, com o objetivo de orientar as companhias para que n\u00e3o se verifiquem os mesmos desvios nas demonstra\u00e7\u00f5es financeiras de 31.12.2008.
