Isso porque entra em vigor do memorando de entendimento firmado em fevereiro deste ano pela Comiss\u00e3o de Valores Mobili\u00e1rios (CVM) com a Autoridade Monet\u00e1ria das Ilhas Cayman (Cima), segundo informou o superintendente em exerc\u00edcio de Rela\u00e7\u00f5es Internacionais da CVM, Augusto Pina. &#8220;Esse memorando firmado com Cayman vai facilitar bastante a troca de informa\u00e7\u00f5es, visando as a\u00e7\u00f5es de investiga\u00e7\u00e3o da CVM&#8221;, disse Augusto Pina.<\/p>\n<p>As Ilhas Cayman s\u00e3o consideradas um &#8220;para\u00edso fiscal&#8221;, ou seja, pa\u00eds com tributa\u00e7\u00e3o da renda inferior a 20%, cuja legisla\u00e7\u00e3o local protege o sigilo relativo \u00e0 composi\u00e7\u00e3o societ\u00e1ria das empresas.<\/p>\n<p><strong>Lavagem de dinheiro<\/p>\n<p><\/strong>Segundo Pina, os dados relativos \u00e0 movimenta\u00e7\u00e3o de contas isentas de tributa\u00e7\u00e3o e que representem lavagem de dinheiro nas Ilhas Cayman poder\u00e3o ser obtidos com mais facilidade a partir de agora. &#8220;Isso se aplica se estiver dentro do escopo de uma investiga\u00e7\u00e3o conduzida pela CVM&#8221;, afirmou.<\/p>\n<p>O memorando prev\u00ea ainda a coopera\u00e7\u00e3o t\u00e9cnica entre os dois \u00f3rg\u00e3os. A CVM \u00e9 uma autarquia vinculada ao Minist\u00e9rio da Fazenda, que responde pela regula\u00e7\u00e3o e fiscaliza\u00e7\u00e3o do mercado de capitais no Brasil.<\/p>\n<p><strong>Para\u00edso fiscal<\/strong><\/p>\n<p>A Lei 11.727 de 2008 ampliou o conceito de para\u00edso fiscal. Considera regime fiscal privilegiado o pa\u00eds que n\u00e3o tribute a renda ou tribute \u00e0 al\u00edquota m\u00e1xima inferior a 20%; conceda vantagem fiscal \u00e0 pessoa f\u00edsica ou jur\u00eddica n\u00e3o residente; e n\u00e3o permite o acesso \u00e0s informa\u00e7\u00f5es relativas \u00e0 composi\u00e7\u00e3o societ\u00e1ria, titularidade de bens ou direitos ou \u00e0s opera\u00e7\u00f5es econ\u00f4micas realizadas.<\/p>\n<p>A CVM mant\u00e9m atualmente 29 memorandos bilaterais firmados com outros \u00f3rg\u00e3os reguladores em todos os continentes.
