{"id":2564,"date":"2009-04-06T11:02:00","date_gmt":"2009-04-06T11:02:00","guid":{"rendered":"http:\/\/alcantara.pro.br\/portal\/2009\/04\/06\/sped-x-sonegacao-fiscal\/"},"modified":"2009-04-06T11:02:00","modified_gmt":"2009-04-06T11:02:00","slug":"sped-x-sonegacao-fiscal","status":"publish","type":"post","link":"https:\/\/alcantara.pro.br\/portal\/2009\/04\/06\/sped-x-sonegacao-fiscal\/","title":{"rendered":"SPED x Sonega\u00e7\u00e3o Fiscal"},"content":{"rendered":"<div align=\"right\"><em><strong>Sped restringe espa\u00e7o das fraudes e torna sonega\u00e7\u00e3o dif\u00edcil <\/strong><\/p>\n<p>Depois de grande esfor\u00e7o para a introdu\u00e7\u00e3o da Nota Fiscal Eletr\u00f4nica (NF-e), o projeto Sistema P\u00fablico de Escritura\u00e7\u00e3o Digital (Sped) ganha um f\u00f4lego extra com a entrada de duas novas obrigatoriedades: a Escritura\u00e7\u00e3o Fiscal Digital (EFD) e a Escritura\u00e7\u00e3o Cont\u00e1bil Digital (ECD).<\/p>\n<p>A regulamenta\u00e7\u00e3o cria um ambiente que permite \u00e0s Secretarias da Fazenda e \u00e0 Receita Federal cruzar informa\u00e7\u00f5es cont\u00e1beis e fiscais, identificando fraudes e sonega\u00e7\u00e3o e cobrindo toda a cadeia produtiva.<\/p>\n<p>Preparar a infraestrutura de TI para a regulamenta\u00e7\u00e3o vem consumindo grande esfor\u00e7o das corpora\u00e7\u00f5es. N\u00e3o se adaptar ou enviar dados errados pode acarretar multas e outras penalidades. Para muitas empresas, mexer nos sistemas a fim de extrair informa\u00e7\u00f5es fiscais e cont\u00e1beis \u00e9 como abrir uma caixa de Pandora.<\/p>\n<p>Para se ter uma ideia do tamanho do &#8220;problema&#8221;, a consultoria fiscal IOB ouviu 405 corpora\u00e7\u00f5es brasileiras com faturamento entre R$ 3 milh\u00f5es e R$ 7 bilh\u00f5es. O estudo revelou que 83% dos entrevistados cometeram algum equ\u00edvoco nestas \u00e1reas em 2007, sendo que 56% deles realizaram transa\u00e7\u00f5es com fornecedores ou clientes inabilitados pelo governo.<\/p>\n<p>As adequa\u00e7\u00f5es dos sistemas ao Sped esbarram na agrega\u00e7\u00e3o de um software paralelo, aquisi\u00e7\u00e3o de equipamentos e amplia\u00e7\u00e3o de links de comunica\u00e7\u00e3o. As dificuldades come\u00e7am pela complicada legisla\u00e7\u00e3o tribut\u00e1ria brasileira, transitam pela necessidade da limpeza e o ajuste dos dados inseridos nos softwares de gest\u00e3o empresariais (ERP), culminando, em muitos casos, na necessidade de mudan\u00e7a de processos e tratamento das informa\u00e7\u00f5es fiscais e cont\u00e1beis dentro dos sistemas de origem.<\/p>\n<p>&#8220;Apenas emitir NF-e, sem ter o controle financeiro e de estoque, n\u00e3o faz os dados fecharem nem que a empresa contrate o ganhador do Pr\u00eamio Nobel para cuidar da contabilidade&#8221;, brinca o autor do livro sobre Sped Big Brother Fiscal, Roberto Dias Duarte.<\/p>\n<p>O especialista aponta que s\u00e3o raras as empresas que t\u00eam esses dados coerentes e prev\u00ea a chegada de uma grande onda de gest\u00e3o nas companhias no Brasil. &#8220;Trata-se da inser\u00e7\u00e3o das autoridades legais na Era do Conhecimento&#8221;, pontua referindo-se \u00e0 necessidade de um maior rigor com os dados imputados pelas corpora\u00e7\u00f5es em seus sistemas.<\/p>\n<p>&#8220;A regulamenta\u00e7\u00e3o imp\u00f5e novos processos de controle e gest\u00e3o, confiabilidade da informa\u00e7\u00e3o, sincroniza\u00e7\u00e3o de cadastros, consist\u00eancia e integra\u00e7\u00e3o entre os sistemas&#8221;, lista Pedro Bicudo, s\u00f3cio-diretor da TGT Consult.
