Em seu voto, a relatora do processo, ministra Eliana Calmon, sustentou que a Lei Complementar n\u00ba 116, de 2003, que determinou o lugar da sede do prestador de servi\u00e7o como o local de recolhimento do ISS, n\u00e3o modificou o entendimento em rela\u00e7\u00e3o \u00e0 constru\u00e7\u00e3o civil.
