Os pronunciamentos tratam, respectivamente, do reconhecimento e mensura\u00e7\u00e3o, da apresenta\u00e7\u00e3o e da evidencia\u00e7\u00e3o de instrumentos financeiros. J\u00e1 a Orienta\u00e7\u00e3o T\u00e9cnica OCPC 3 estabelece de maneira resumida como a entidade classifica seus instrumentos financeiros ativos e passivos, como os mensura, quando os reconhece no balan\u00e7o patrimonial e como os divulga, dando tamb\u00e9m o tratamento relativo \u00e0s suas muta\u00e7\u00f5es no resultado ou no patrim\u00f4nio l\u00edquido.<\/span><\/div>\n<div style=\"text-align: justify;\"><span style=\"color: rgb(0, 0, 0);font-family:Verdana;font-size:85%;\"  ><\/p>\n<p>Os Pronunciamentos T\u00e9cnicos seguem as normas <b>Financial Instruments: Recognition and Measurement <\/b>\u2013 IAS 39, <b>Financial Instruments: Presentation \u2013 <\/b>IAS 32 e <b>Financial Instruments: Disclosures<\/b> \u2013 IFRS 7 emitidas pelo International Accounting Standards Board &#8211; IASB, que j\u00e1 vinham sendo parcialmente aplicados desde 2008 em decorr\u00eancia da edi\u00e7\u00e3o da Delibera\u00e7\u00e3o CVM 566\/08, que aprovou o Pronunciamento T\u00e9cnico CPC 14, e que agora, mais ampliado, se transforma na OCPC 03.<\/p>\n<p><\/span><\/p>\n<\/div>\n<div style=\"text-align: justify;\"><span style=\"color: rgb(0, 0, 0);font-family:Verdana;font-size:85%;\"  >O Pronunciamento <b>CPC 38<\/b> \u2013 &#8220;Instrumentos Financeiros: Reconhecimento e Mensura\u00e7\u00e3o&#8221; disciplina o reconhecimento e a mensura\u00e7\u00e3o de opera\u00e7\u00f5es realizadas com instrumentos financeiros, incluindo derivativos, e o procedimento aplic\u00e1vel ao reconhecimento cont\u00e1bil  das opera\u00e7\u00f5es de <i>hedge<\/i>. Nesse \u00faltimo s\u00e3o definidos, sob a \u00f3tica cont\u00e1bil, os limites para que uma opera\u00e7\u00e3o de <i>hedge<\/i> possa ser considerada como de prote\u00e7\u00e3o efetiva, bem como a documenta\u00e7\u00e3o necess\u00e1ria para sua comprova\u00e7\u00e3o.<\/span><\/p>\n<\/div>\n<div style=\"text-align: justify;\"><span style=\"color: rgb(0, 0, 0);font-family:Verdana;font-size:85%;\"  >O Pronunciamento <b>CPC 39<\/b> \u2013 &#8220;Instrumentos Financeiros: Apresenta\u00e7\u00e3o&#8221; define termos importantes a serem utilizados quando da leitura de normas que envolvam instrumentos financeiros, principalmente os CPC\u2019s 38 e 40, tais como, ativo financeiro, passivo financeiro, instrumento patrimonial, valor justo e instrumento resgat\u00e1vel. Trata, ainda, de um aspecto relevante no sentido da preval\u00eancia da ess\u00eancia econ\u00f4mica sobre a forma jur\u00eddica, que \u00e9 a determina\u00e7\u00e3o das circunst\u00e2ncias que qualificam os instrumentos financeiros a serem reconhecidos como instrumentos de d\u00edvida ou patrimonial.<\/span><\/p>\n<\/div>\n<div style=\"text-align: justify;\"><span style=\"color: rgb(0, 0, 0);font-family:Verdana;font-size:85%;\"  >O Pronunciamento <b>CPC 40<\/b> \u2013 &#8220;Instrumentos Financeiros: Evidencia\u00e7\u00e3o&#8221; estabelece as informa\u00e7\u00f5es m\u00ednimas que devem ser divulgadas nas demonstra\u00e7\u00f5es cont\u00e1beis que permita a seus usu\u00e1rios avaliar a signific\u00e2ncia do instrumento financeiro para a posi\u00e7\u00e3o patrimonial\/financeira e o desempenho da entidade. Al\u00e9m disso, determina divulga\u00e7\u00f5es que permitam a avalia\u00e7\u00e3o da natureza e extens\u00e3o dos riscos a que a entidade est\u00e1 exposta num per\u00edodo de refer\u00eancia, resultante de instrumentos financeiros,  e como a entidade administra esses riscos.<\/span><\/p>\n<\/div>\n<div style=\"text-align: justify;\"><span style=\"color: rgb(0, 0, 0);font-family:Verdana;font-size:85%;\"  >A Orienta\u00e7\u00e3o <b>OCPC \u2013 03<\/b> \u00e9 produto da revis\u00e3o e transforma\u00e7\u00e3o do Pronunciamento CPC 14, editado para permitir a regula\u00e7\u00e3o de dispositivos da Lei 11.638\/07 que tratam de transa\u00e7\u00f5es com instrumentos financeiros, e que visava ser uma norma resumida e simplificada de suporte \u00e0s companhias que n\u00e3o incorressem em transa\u00e7\u00f5es financeiras sofisticadas. Nessa oportunidade, foram para ele convergidos partes dos IAS 32 e 39 consideradas como um conjunto m\u00ednimo de procedimentos essenciais para regulamenta\u00e7\u00e3o das determina\u00e7\u00f5es prescritas na Lei 11.638\/07 sobre reconhecimento, mensura\u00e7\u00e3o e evidencia\u00e7\u00e3o de instrumentos financeiros. \u00c0 \u00e9poca, \u00e9 conveniente lembrar, a agenda conjunta CVM\/CPC previa a normatiza\u00e7\u00e3o de instrumentos financeiros em duas fases: a primeira, que culminou na emiss\u00e3o do CPC 14 e a segunda, agora, com a edi\u00e7\u00e3o dos CPC\u2019s 38,39 e 40, que convergem integralmente aos seus pares emitidos pelo IASB. Dessa forma, considerou-se que a manuten\u00e7\u00e3o do CPC 14 representaria uma duplicidade desnecess\u00e1ria e, por outro lado, que sua revoga\u00e7\u00e3o significaria uma perda devido a sua caracter\u00edstica sint\u00e9tica e objetiva. Por conta disso, decidiu-se pela sua manuten\u00e7\u00e3o, transformando-o numa Orienta\u00e7\u00e3o de forma a servir de guia no reconhecimento, mensura\u00e7\u00e3o e divulga\u00e7\u00e3o de transa\u00e7\u00f5es com instrumentos financeiros para as companhias que n\u00e3o incorram em transa\u00e7\u00f5es sofisticadas com os referidos instrumentos.
