O prazo de pagamento de d\u00edvidas referentes a crimes tribut\u00e1rios, sonega\u00e7\u00e3o ou apropria\u00e7\u00e3o ind\u00e9bita de contribui\u00e7\u00e3o previdenci\u00e1ria ser\u00e1 limitado a cinco anos.<\/em><\/span><\/span><\/div>\n

<\/p>\n

A proposta consta no Projeto de Lei 6.281\/09, da Comiss\u00e3o de Legisla\u00e7\u00e3o Participativa, que tramita na C\u00e2mara dos Deputados e altera a Lei 10.684\/03, que suspende a puni\u00e7\u00e3o penal enquanto o saldo estiver sendo parcelado \u2013 mas n\u00e3o fixa prazo para a quita\u00e7\u00e3o. <\/div>\n
<\/span><\/span>Segundo o deputado Roberto Britto (PP-BA), que preside a comiss\u00e3o, o objetivo do texto \u00e9 dar tratamento mais adequado a esses tipos de crime, pois “h\u00e1 casos de parcelamentos de dezenas de anos e isso acaba impedindo a san\u00e7\u00e3o penal”. <\/span><\/span><\/div>\n

Outra mudan\u00e7a proposta pelo texto \u00e9 que, mesmo ap\u00f3s quitar a d\u00edvida, o infrator tenha sua pena reduzida pela metade. <\/span><\/div>\n
Pela legisla\u00e7\u00e3o atualmente em vigor, o pagamento extingue a punibilidade. “Isso equivale a libertar um ladr\u00e3o de autom\u00f3vel somente pelo fato de ele ter devolvido o bem ao propriet\u00e1rio: um verdadeiro contrassenso”, diz Britto. <\/span><\/div>\n
A proposta tamb\u00e9m estabelece que o agente p\u00fablico que tomar conhecimento de um suposto crime tribut\u00e1rio ou previdenci\u00e1rio e n\u00e3o comunicar ao Minist\u00e9rio P\u00fablico em at\u00e9 30 dias, responder\u00e1 por crime de prevarica\u00e7\u00e3o, sem preju\u00edzo das responsabilidades civil e administrativa. <\/span><\/div>\n
Esse crime \u00e9 definido pelo C\u00f3digo Penal como “retardar ou deixar de praticar, indevidamente, ato de of\u00edcio, ou pratic\u00e1-lo contra disposi\u00e7\u00e3o expressa de lei, para satisfazer interesse ou sentimento pessoal”.
A pena \u00e9 de deten\u00e7\u00e3o de tr\u00eas meses a um ano e multa. <\/span><\/div>\n
O projeto, que tramita em regime de prioridade, ser\u00e1 analisado pelas comiss\u00f5es de Desenvolvimento Econ\u00f4mico, Ind\u00fastria e Com\u00e9rcio; de Finan\u00e7as e Tributa\u00e7\u00e3o; e de Constitui\u00e7\u00e3o e Justi\u00e7a e de Cidadania. Depois, ser\u00e1 encaminhado ao Plen\u00e1rio. <\/span><\/div>\n
Previstos na Lei 8.137\/90, os crimes tribut\u00e1rios incluem sonega\u00e7\u00e3o de impostos, falsifica\u00e7\u00e3o de nota fiscal e documentos cont\u00e1beis. A pena vai de reclus\u00e3o a deten\u00e7\u00e3o, e multa.<\/span><\/div>\n
