Segundo a ag\u00eancia, elas &#8220;prendem&#8221; os clientes em contratos que preveem multas  caso eles cancelem o servi\u00e7o antes de um ano.<br \/>Ainda segundo a ag\u00eancia,  justamente por isso, haveria uma resist\u00eancia das teles ao desbloqueio desses  aparelhos, que, uma vez destravados, poderiam funcionar com chips de outras  operadoras, gerando receita para a concorr\u00eancia.<\/span><\/p>\n<p align=\"justify\"><span style=\"font-family:Arial;font-size:85%;\">O assunto entrou na pauta de discuss\u00e3o dos conselheiros da  Anatel no fim do ano passado e s\u00f3 deve ser retomado no pr\u00f3ximo dia 28, quando  retorna das f\u00e9rias o presidente da ag\u00eancia, Ronaldo Sardenberg.<br \/>Caso o  conselho aprove as novas normas, a ag\u00eancia enviar\u00e1 uma s\u00famula ao &#8220;Di\u00e1rio Oficial  da Uni\u00e3o&#8221; e, imediatamente ap\u00f3s sua publica\u00e7\u00e3o, as operadoras ficar\u00e3o obrigadas  a desbloquear qualquer celular a pedido do cliente, sem custos.<\/span><\/p>\n<p align=\"justify\"><span style=\"font-family:Arial;font-size:85%;\">&#8220;O desbloqueio \u00e9 um direito do cliente&#8221;, diz a conselheira  Emilia Ribeiro, relatora do processo. &#8220;As operadoras n\u00e3o podem bloquear  aparelhos como contrapartida \u00e0 concess\u00e3o do subs\u00eddios aos telefones.&#8221;<br \/>Para  ela, isso j\u00e1 estava previsto no Regulamento do Servi\u00e7o M\u00f3vel Pessoal, mas houve  uma pol\u00eamica em torno do caso quando, em janeiro de 2008, a Oi enviou \u00e0 Anatel  uma reclama\u00e7\u00e3o formal, exigindo que a concorr\u00eancia cumprisse as regras e fizesse  o desbloqueio.<\/span><\/p>\n<p align=\"justify\"><span style=\"font-family:Arial;font-size:85%;\">A Oi \u00e9 a \u00fanica operadora no pa\u00eds cujo modelo de neg\u00f3cio est\u00e1  baseado na venda do chip, e n\u00e3o na da linha com aparelho subsidiado. Vivo, TIM e  Claro tamb\u00e9m passaram a vender chips avulsos, mas, at\u00e9 o momento, ainda centram  suas receitas na venda dos aparelhos.<\/span><\/p>\n<p align=\"justify\"><span style=\"font-family:Arial;font-size:85%;\">Por meio de sua assessoria de imprensa, a Vivo informa que  vende celulares bloqueados e desbloqueados e faz o desbloqueio, sem custo, para  os clientes &#8220;fidelizados&#8221;. A Claro diz que destrava gratuitamente os aparelhos a  pedido do cliente.<\/span><\/p>\n<p align=\"justify\"><span style=\"font-family:Arial;font-size:85%;\">A TIM deu um passo al\u00e9m e anunciou que vender\u00e1 telefones  desbloqueados de f\u00e1brica a partir de fevereiro.
