Na m\u00e9dia desses 20 anos, foram editadas 34 altera\u00e7\u00f5es por dia.<\/span><\/span><\/div>\n<div align=\"justify\"><span style=\"font-family:Arial;font-size:85%;color:#000000;\">&#8220;O que acaba ocorrendo \u00e9 um parasitismo nosso, dos advogados, para se aproveitar dessa confus\u00e3o&#8221;, diz Carlos Sundfeld, da Direito GV.<\/span><\/div>\n<div align=\"justify\"><span style=\"font-family:Arial;font-size:85%;color:#000000;\">Segundo ele, um dos exemplos emblem\u00e1ticos do &#8220;manic\u00f4mio tribut\u00e1rio&#8221; \u00e9 o hist\u00f3rico dos \u00faltimos anos da lei 8.666, de 1993, conhecida como Lei das Licita\u00e7\u00f5es.<\/span><\/div>\n<p><span style=\"font-family:Arial;font-size:85%;\"><\/p>\n<div align=\"justify\"><span style=\"color:#000000;\">\u00c9 por meio dela que s\u00e3o fechados milhares de contratos entre a iniciativa privada e o setor p\u00fablico.<\/span><\/span><\/div>\n<div align=\"justify\"><span style=\"font-family:Arial;font-size:85%;color:#000000;\">&#8220;Uma s\u00e9rie de pequenas mudan\u00e7as, no lugar de uma nova reformula\u00e7\u00e3o, acabou gerando mais incertezas e confus\u00e3o&#8221;, diz Sundfeld. Ele caracteriza a 8.666 hoje como &#8220;um desastre formal&#8221;.<\/span><\/div>\n<p><span style=\"font-family:Arial;font-size:85%;\"><\/p>\n<div align=\"justify\"><span style=\"color:#000000;\">Antonio do Amaral, da OAB, diz que os custos e riscos relacionados \u00e0 tributa\u00e7\u00e3o fazem com que a &#8220;inseguran\u00e7a jur\u00eddica&#8221; seja o &#8220;t\u00f4nus dominante&#8221; entre as empresas.<\/span><\/div>\n<div align=\"justify\"><span style=\"color:#000000;\">&#8220;Uma tributa\u00e7\u00e3o n\u00e3o contemplada pode resultar, no limite, em multas que inviabilizam a empresa&#8221;, diz.<\/span><\/span><\/div>\n<div align=\"justify\"><span style=\"font-family:Arial;font-size:85%;color:#000000;\">Para Jo\u00e3o Eloi Olenike, presidente do IBPT, n\u00e3o \u00e9 s\u00f3 o desacordo entre Uni\u00e3o, Estados e munic\u00edpios que impede a reforma tribut\u00e1ria para simplificar a arrecada\u00e7\u00e3o.<br \/>&#8220;O governo n\u00e3o quer mexer nisso, pois a verdade \u00e9 que ele arrecada tudo o que precisa&#8221;, diz Olenike.<\/span><\/div>\n<div align=\"justify\"><span style=\"font-family:Arial;font-size:85%;color:#000000;\">Para Sundfeld, no que se refere \u00e0 arrecada\u00e7\u00e3o, o sistema &#8220;\u00e9 extremamente eficiente&#8221;. &#8220;O problema \u00e9 que n\u00e3o conseguimos burilar e simplificar. \u00c9 disso que estamos falando.&#8221;
