\tA Receita Federal (RFB) deflagra, hoje (28\/05), uma grande operação de combate a empresas “laranja”. O objetivo da operação é verificar se efetivamente essas empresas existem e se estão operando normalmente. Caso contrário, o Cadastro Nacional da Pessoa Jurídica (CNPJ) de cada uma delas será imediatamente suspenso, impedindo que elas continuem a emitir documentos fiscais.<\/span><\/span><\/div>\n
\t <\/div>\n

<\/p>\n

\tAs 278 empresas foram selecionadas a partir de cruzamentos efetuados entre os diversos sistemas informatizados da Receita Federal. Apesar de terem emitido valores expressivos de notas fiscais de venda de mercadorias ou prestação de serviços em 2014, essas empresas não recolheram tributos. Elas também não possuem empregados registrados, não estão estabelecidas em endereços compatíveis com suas atividades e não apresentam movimentações bancárias correspondentes ao suposto faturamento. <\/span><\/span><\/div>\n
\t <\/div>\n
\tNesse contexto, existem fortes indícios de que funcionam apenas como empresas “de fachada” ou “noteiras”.<\/span><\/span><\/div>\n
\t <\/div>\n
\tTais empresas são utilizadas para diversos fins, todos ilegais: acobertamento do verdadeiro fornecedor das mercadorias ou prestador dos serviços, criação de créditos tributários ilegítimos, sonegação, importações fraudulentas, lavagem de dinheiro, corrupção etc.<\/span><\/span><\/div>\n
\t <\/div>\n
\tNos casos em que ficar constatada a fraude, ocorrerá a imediata suspensão do cadastro das empresas. Após intimação aos sócios, os CNPJ deverão ser definitivamente baixados de ofício.<\/span><\/span><\/div>\n
\t <\/div>\n
\tAlém dos aspectos tributários e administrativos envolvidos, os responsáveis pela criação e operação das empresas “laranja” poderão responder, também, no âmbito criminal, por eventuais crimes praticados com a sua utilização.<\/span><\/span><\/div>\n
