O texto autoriza o Conselho Monet\u00e1rio Nacional (CMN) a definir valores m\u00e1ximos e regras para pagamentos em esp\u00e9cie, com o objetivo de refor\u00e7ar o combate \u00e0 lavagem de dinheiro. Do senador Fl\u00e1vio Arns (PSB-PR), o projeto foi aprovado na forma de substitutivo do senador Oriovisto Guimar\u00e3es (PSDB-PR) e por isso passar\u00e1 por uma vota\u00e7\u00e3o suplementar na CCJ.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\">O <a href=\"https:\/\/www25.senado.leg.br\/web\/atividade\/materias\/-\/materia\/137646\" target=\"_blank\" rel=\"noopener\">PL 3.951\/2019<\/a> altera a Lei de Lavagem de Dinheiro (<a href=\"https:\/\/normas.leg.br\/?urn=urn:lex:br:federal:lei:1998-03-03;9613\" target=\"_blank\" rel=\"noopener\">Lei 9.613, de 1998<\/a>) para determinar que o CMN, ouvido o Conselho de Controle de Atividades Financeiras (Coaf), definir\u00e1 os valores m\u00e1ximos e as condi\u00e7\u00f5es para pagamentos e transa\u00e7\u00f5es realizadas em esp\u00e9cie, inclusive no caso de cheques e boletos banc\u00e1rios.\u00a0O substitutivo de Oriovisto mant\u00e9m a emenda aprovada na Comiss\u00e3o de Assuntos Econ\u00f4micos (CAE) que pro\u00edbe, de forma expressa, o uso de qualquer valor em esp\u00e9cie em transa\u00e7\u00f5es imobili\u00e1rias.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\"><strong>Par\u00e2metros do Conselho Monet\u00e1rio Nacional<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\">A vers\u00e3o original do projeto estabelecia diretamente os seguintes limites para opera\u00e7\u00f5es em esp\u00e9cie:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\">Proibi\u00e7\u00e3o de uso de dinheiro em esp\u00e9cie em transa\u00e7\u00f5es comerciais ou profissionais acima de R$ 10 mil;<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\">Proibi\u00e7\u00e3o de pagamento de boletos em esp\u00e9cie acima de R$ 5 mil;<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\">Restri\u00e7\u00e3o \u00e0 circula\u00e7\u00e3o de dinheiro vivo em montantes superiores a R$ 100 mil, salvo com comprova\u00e7\u00e3o de origem e destino l\u00edcitos;<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\">Proibi\u00e7\u00e3o de posse de valores acima de R$ 300 mil, exceto em situa\u00e7\u00f5es justificadas; e<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\">Penalidades de multa e confisco em caso de descumprimento das regras, com recursos revertidos ao Coaf.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\">Para o relator Oriovisto, al\u00e9m de &#8220;excessivamente detalhadas&#8221;, as regras extrapolariam os limites do poder normativo do Congresso. Ele argumenta que a defini\u00e7\u00e3o dos par\u00e2metros operacionais e limites financeiros deve ser feita por \u00f3rg\u00e3o t\u00e9cnico competente, com base em crit\u00e9rios atualizados e flex\u00edveis, justificando a transfer\u00eancia dessa atribui\u00e7\u00e3o ao Conselho Monet\u00e1rio Nacional.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\"><strong>Lavagem de dinheiro<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\">Segundo o relator, o projeto foi inspirado na publica\u00e7\u00e3o Novas Medidas Contra a Corrup\u00e7\u00e3o, lan\u00e7ada pela FGV e pela Ong Transpar\u00eancia Internacional, e tem como objetivo contribuir com mecanismos legais de enfrentamento \u00e0 lavagem de dinheiro, ao financiamento do terrorismo e \u00e0 corrup\u00e7\u00e3o. Ele ainda informou que essa \u00e9 uma demanda, inclusive, dos diretores do Banco Central e do Coaf.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<blockquote><p><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\">\u2014 Esse projeto \u00e9 bastante simples e trata de regular o uso do dinheiro em esp\u00e9cie. Ali\u00e1s, nos tivemos uma audi\u00eancia com o presidente do Banco Central, Gabriel Gal\u00edpollo e com o presidente do Coaf [Ricardo Saadi], em que eles reclamavam da falta de instrumento para estabelecer determinados controles, sobretudo na lavagem de dinheiro.
