O texto estabelece regras mais r\u00edgidas para identificar e punir o devedor contumaz, aquele que de forma reiterada transforma o n\u00e3o pagamento de tributos em modelo de neg\u00f3cio, ferindo a livre concorr\u00eancia e enfraquecendo a arrecada\u00e7\u00e3o p\u00fablica.<\/p>\n<p style=\"text-align: justify;\">A distin\u00e7\u00e3o entre o devedor eventual, que por motivos concretos enfrenta dificuldades em seu neg\u00f3cio, e o devedor contumaz \u00e9 essencial. O primeiro de fato precisa de apoio e pol\u00edticas de recupera\u00e7\u00e3o, j\u00e1 o segundo, de responsabiliza\u00e7\u00e3o. O PLP 125\/2022 introduz crit\u00e9rios objetivos para essa diferencia\u00e7\u00e3o, dando seguran\u00e7a jur\u00eddica e fortalecendo o combate \u00e0 fraude fiscal planejada.<\/p>\n<p style=\"text-align: justify;\">Sob a \u00f3tica policial, essa mudan\u00e7a \u00e9 vital. A experi\u00eancia da Delegacia Fazend\u00e1ria (DEFAZ\/MT) mostra que o devedor contumaz raramente atua sozinho, para al\u00e9m da utiliza\u00e7\u00e3o do n\u00e3o pagamento como m\u00e9todo de sonega\u00e7\u00e3o, ele tamb\u00e9m flerta com empresas fantasmas e <strong>fraudes cont\u00e1beis para ocultar patrim\u00f4nio e frustrar o fisco<\/strong>. Em muitos casos, essas condutas evoluem para crimes de lavagem de dinheiro, falsidade ideol\u00f3gica e associa\u00e7\u00e3o criminosa, exigindo investiga\u00e7\u00f5es complexas e coopera\u00e7\u00e3o entre institui\u00e7\u00f5es.<\/p>\n<p style=\"text-align: justify;\">A aprova\u00e7\u00e3o do PLP 125\/2022 \u00e9, portanto, um marco de justi\u00e7a fiscal. Ela permitir\u00e1 que as Secretarias de Fazenda, Minist\u00e9rios P\u00fablicos, Procuradorias e Pol\u00edcias Judici\u00e1rias atuem de forma coordenada, refor\u00e7ando o combate \u00e0 sonega\u00e7\u00e3o e promovendo um ambiente de neg\u00f3cios mais \u00e9tico e previs\u00edvel.<\/p>\n<p style=\"text-align: justify;\">A sonega\u00e7\u00e3o como venho pregando reiteradamente n\u00e3o \u00e9 um crime sem v\u00edtima, ela subtrai recursos da sa\u00fade, da educa\u00e7\u00e3o e da seguran\u00e7a p\u00fablica. Combater o devedor contumaz \u00e9 proteger o cidad\u00e3o de bem e valorizar o contribuinte que cumpre suas obriga\u00e7\u00f5es, al\u00e9m de impedir a cria\u00e7\u00e3o de um ambiente de concorr\u00eancia desleal, que acaba sendo um dos efeitos diretos e imediatos da sonega\u00e7\u00e3o.<\/p>\n<p style=\"text-align: justify;\">Mais do que endurecer regras, o PLP 125\/2022 reafirma um princ\u00edpio: \u201cquem lucra \u00e0 sombra da ilegalidade deve responder por isso\u201d.
