\tSe um pai paga pensão para um filho de livre e espontânea vontade, sem nenhum respaldo jurídico, ele não pode deduzir a despesa na declaração do Imposto de Renda. Se um pai paga em média R$ 1.200 por mês para a escola ou faculdade, o que dá uma soma de R$ 14.400 por ano, só poderá deduzir até R$ 3.091,35. Se gastar uma fortuna com remédios, nada poderá ser descontado. Entre as injustiças na hora de declarar, essas estão entre as mais apontadas pelos contribuintes. <\/span><\/span><\/div>\n

\tPelo menos no caso da educação, há chances de a injustiça tributária ser reparada. Nos próximos dias, o Supremo Tribunal Federal (STF) deve julgar a Ação Direta de Inconstitucionalidade (Adin) movida pelo Conselho Federal da Ordem dos Advogados do Brasil (OAB) em março, pedindo o fim do limite. <\/span><\/span><\/div>\n
\t <\/div>\n
\tNo dia 18 de abril, a ministra Rosa Weber resolveu apressar o julgamento e deu dez dias para que Câmara, Senado e Presidência prestem informações. Depois, a Advocacia Geral da União (AGU) e a Procuradoria Geral da República (PGR) terão cinco dias para a apresentação de parecer.<\/span><\/span><\/div>\n

\tNa opinião do especialista em direito tributário João Manoel Rolla, do escritório Rodolfo Gropen, a imposição de limites é inconstitucional porque fere o direito à educação. "O contribuinte paga imposto para que o Estado forneça um serviço público de qualidade, mas não recebe e tem que recorrer a instituições privadas", justifica o jurista.<\/span><\/span><\/div>\n

\tNa avaliação dele, entretanto, conseguir derrubar o limite de dedução com educação é um desafio, uma vez que passa por discussões de orçamento público. <\/span><\/span><\/div>\n

\tPara o professor de finanças da IBS\/Fundação Getúlio Vargas (FGV), Ewerson Moraes, as regras existem para serem cumpridas, mas muitas injustiças deveriam ser reparadas na declaração do IR. "As maiores delas são o limite de gastos com educação, o fato de não ser permitido deduzir os gastos com medicamentos e a forma de corrigir a tabela do IR, que foi reajustada abaixo da inflação, fazendo com que mais gente que recebe menos tenha que pagar o imposto", ressalta Moraes. <\/span><\/span><\/div>\n

\tO professor afirma ainda que, a exemplo do que a OAB fez ao questionar judicialmente o limite da educação, outras entidades também deveriam fazer. "As pessoas reclamam, mas não se mobilizam, ninguém se manifesta. Reclamar sem se mobilizar é muito cômodo", destaca Moraes. <\/span><\/span><\/div>\n

\tNa Adin, a OAB esclarece que não defende a extinção do dispositivo, mas quer que ele corresponda aos gastos reais com ensino.<\/span><\/span><\/div>\n
