O montante foi identificado em levantamento feito pelo Valor em notas explicativas de balan&ccedil;os das maiores empresas do pa&iacute;s referentes a dezembro de 2012.<\/span><\/span><\/div>\n<div style=\"text-align: justify;\"> \t&nbsp;<\/div>\n<div style=\"text-align: justify;\"> \t<span style=\"font-size:14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Mas na maior parte dos casos as autua&ccedil;&otilde;es se referem aos resultados apurados at&eacute; o exerc&iacute;cio de 2008 &#8211; o que significa que outras ainda podem surgir. A pr&oacute;pria Vale informou ontem que sua disputa pode chegar a R$ 49,4 bilh&otilde;es at&eacute; 2012 se novas autua&ccedil;&otilde;es forem feitas &#8211; ante um valor de R$ 31 bilh&otilde;es j&aacute; oficialmente requerido pelo Fisco.<\/span><\/span><\/div>\n<div style=\"text-align: justify;\"> \t&nbsp;<\/div>\n<div style=\"text-align: justify;\"> \t<span style=\"font-size:14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Depois da Vale, aparecem no levantamento os casos de Petrobras e Ambev, com R$ 3,4 bilh&otilde;es e R$ 2,6 bilh&otilde;es em discuss&atilde;o, respectivamente. Ainda com processos superando a casa do bilh&atilde;o surgem CSN (R$ 2,0 bilh&otilde;es), Fibria (R$ 1,5 bilh&atilde;o) e Gerdau (R$ 1,3 bilh&atilde;o).<\/span><\/span><\/div>\n<div style=\"text-align: justify;\"> \t&nbsp;<\/div>\n<div style=\"text-align: justify;\"> \t<span style=\"font-size:14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Das 13 companhias identificadas no levantamento, apenas o Ita&uacute;, que disputa um valor de R$ 515 milh&otilde;es, possui provis&atilde;o para perda. Pela regra do Banco Central, a institui&ccedil;&atilde;o precisa tratar a cobran&ccedil;a como obriga&ccedil;&atilde;o legal e constituir a reserva, mesmo que considere a cobran&ccedil;a ilegal e tenha chances de vencer o processo.<\/span><\/span><\/div>\n<div style=\"text-align: justify;\"> \t&nbsp;<\/div>\n<div style=\"text-align: justify;\"> \t<span style=\"font-size:14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Todas as demais tratam os casos como de perda poss&iacute;vel (n&atilde;o prov&aacute;vel), o que exige apenas divulga&ccedil;&atilde;o em nota explicativa, sem provis&atilde;o. Isso significa que, se os resultados dos julgamentos (que t&ecirc;m repercuss&atilde;o geral) forem contr&aacute;rios aos contribuintes e levarem a uma mudan&ccedil;a na expectativa de perda das empresas, de poss&iacute;vel para prov&aacute;vel, elas ter&atilde;o que constituir a provis&atilde;o. Esse registro entraria como uma despesa no balan&ccedil;o, embora n&atilde;o signifique desembolso imediato de caixa.<\/span><\/span><\/div>\n<div style=\"text-align: justify;\"> \t&nbsp;<\/div>\n<div style=\"text-align: justify;\"> \t<span style=\"font-size:14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A mudan&ccedil;a de expectativa, contudo, n&atilde;o est&aacute; ligada diretamente ao julgamento do STF. Depende da avalia&ccedil;&atilde;o das pr&oacute;prias companhias e de seus consultores jur&iacute;dicos sobre o caso espec&iacute;fico e a jurisprud&ecirc;ncia.<\/span><\/span><\/div>\n<div style=\"text-align: justify;\"> \t&nbsp;<\/div>\n<div style=\"text-align: justify;\"> \t<span style=\"font-size:14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O ministro relator Joaquim Barbosa, por exemplo, apresentou ontem um conceito novo na disputa, de que o Imposto de Renda e a CSLL seriam devidos apenas se a controlada no exterior estiver em para&iacute;so fiscal.
