A iniciativa visa evitar que conflitos relacionados a tributos ou quest\u00f5es aduaneiras se transformem em lit\u00edgios, incentivando a resolu\u00e7\u00e3o por meio de di\u00e1logo entre a Receita e os contribuintes.<\/p>\n<p>A ades\u00e3o ao Receita de Consenso \u00e9 limitada aos contribuintes com a mais alta classifica\u00e7\u00e3o em Programas de Est\u00edmulo \u00e0 Conformidade da Receita Federal. Esses contribuintes poder\u00e3o solicitar a participa\u00e7\u00e3o em duas situa\u00e7\u00f5es:<\/p>\n<ul>\n<li>Diverg\u00eancias em procedimentos fiscais j\u00e1 em andamento.<\/li>\n<li>D\u00favidas sobre as consequ\u00eancias tribut\u00e1rias de neg\u00f3cios jur\u00eddicos antes de qualquer procedimento fiscal.<\/li>\n<\/ul>\n<p><strong>Exclus\u00f5es<\/strong><\/p>\n<p>Casos envolvendo ind\u00edcios de crimes tribut\u00e1rios ou aduaneiros, como sonega\u00e7\u00e3o, fraude, descaminho e contrabando, est\u00e3o exclu\u00eddos do procedimento. Tamb\u00e9m ficam de fora infra\u00e7\u00f5es pun\u00edveis com pena de perdimento, ou situa\u00e7\u00f5es em que o prazo para lan\u00e7amento do cr\u00e9dito tribut\u00e1rio seja igual ou inferior a 360 dias.<\/p>\n<p><strong>Funcionamento<\/strong><\/p>\n<p>A admissibilidade para ingressar no Receita de Consenso ser\u00e1 analisada por uma equipe distinta daquela respons\u00e1vel pela condu\u00e7\u00e3o do procedimento consensual. As demandas ser\u00e3o analisadas pelo Centro de Preven\u00e7\u00e3o e Solu\u00e7\u00e3o de Conflitos Tribut\u00e1rios e Aduaneiros (Cecat). O processo prev\u00ea a realiza\u00e7\u00e3o de audi\u00eancias, que ser\u00e3o gravadas, para garantir o di\u00e1logo transparente entre as partes.<\/p>\n<p>Os contribuintes devem protocolizar o requerimento por meio do Portal de Servi\u00e7os da Receita Federal, descrevendo objetivamente o fato tribut\u00e1rio ou aduaneiro envolvido.<\/p>\n<p>Contribuintes participantes dos Programas OEA (Operador Econ\u00f4mico Autorizado) e Confia ter\u00e3o prioridade no processamento de suas demandas.<\/p>\n<p><strong>N\u00e3o aplica\u00e7\u00e3o de multas<\/strong><\/p>\n<p>Se houver consenso, o respons\u00e1vel pelo procedimento propor\u00e1 um termo de consensualidade, que, uma vez aceito, resultar\u00e1 na emiss\u00e3o de um Ato Declarat\u00f3rio Executivo.
