\tSabe-se que o valor das autuações feitas pelo Fisco em 2011 registrou um aumento de 21,2%, batendo o recorde histórico de R$ 109 bilhões. Porém, é consenso entre os especialistas que este valor deverá aumentar ainda mais, como decorrência da própria evolução do projeto SPED (Sistema Público de Escrituração Digital), que possibilita o cruzamento eletrônico instantâneo de todo o histórico fiscal das empresas brasileiras. O grande risco, nestes casos, é que à medida que o projeto evolui, o contribuinte fica mais exposto, e parece ainda não se preocupar com isso.<\/span><\/span><\/div>\n

\tTomemos por base, por exemplo, a própria ECD (Escrituração Contábil Digital), uma das primeiras obrigações anunciadas para o SPED Contábil, que espelha toda a contabilidade das empresas. Quase três anos após sua primeira entrega via modelo eletrônico, realizada em 2009, mas referente aos dados de 2008, poucas foram as companhias que revisitaram o seu processo interno ou pararam para avaliar não mais o formato de entrega, mas o conteúdo que está sendo entregue.<\/span><\/span><\/div>\n

\tÉ compreensível que, sobretudo no início, o acompanhamento dos projetos SPED tenha se mostrado mais complexo do que o previsto, resultando em companhias que, mesmo investindo pesado em software e outras soluções, ainda continuaram em desacordo com as exigências legais por conta de falhas na geração e armazenamento dos dados. Porém, se antes a preocupação maior foi conseguir validar o arquivo digital e enviá-lo no formato correto ao Fisco, à medida que novas obrigações acessórias vão entrando em vigor – como a própria EFD-Contribuições, torna-se imprescindível que as empresas também se atentem para a convergência das informações que estão distribuídas por todos os documentos eletrônicos.<\/span><\/span><\/div>\n

\tPercebemos atualmente, pelo perfil de autuações feitas pela Receita Federal, que ela parece estar focada em contestar valores, e não tanto processos contábeis. Há casos de empresas, por exemplo, que entregam obrigações com somas finais corretas, provavelmente simuladas, porém com grandes divergências entre os índices de entrada e saída de suas operações. A expectativa é que em um futuro próximo este tipo de inconsistência processual também seja alvo de multas.<\/span><\/span><\/div>\n

\tUma prova de que o cruzamento estratégico das informações entregues ao Fisco já está sendo feito é que apesar de o valor das autuações ter aumentado em 2011, o número de ações de fiscalização recuou 25%, para 407 mil. A eficiência dessas operações deverá aumentar ainda mais por conta dos investimentos do Governo em tecnologias analíticas, além da própria maturidade do projeto SPED, que em 2013 deverá contemplar no formato digital cerca de 95% de todas as obrigações exigentes.<\/span><\/span><\/div>\n

\tDiante deste cenário, a prevenção torna-se a melhor ferramenta disponível no mercado, e projetos de consultoria e auditoria ganham um espaço cada vez mais vital para o negócio. Vale lembrar que, quanto antes as empresas tiverem a garantia da qualidade dos seus dados, menor será sua exposição a multas. Para isso, não há outro caminho senão revisitar processos e cruzar os próprios dados, antes que o próprio Fisco o faça.<\/span><\/span><\/div>\n
