O ministro da Fazenda, Guido Mantega, pediu que o Senado aprove o mais r&aacute;pido poss&iacute;vel a proposta de emenda constitucional (PEC) que muda o sistema de cobran&ccedil;a do ICMS nas vendas pela internet, o chamado com&eacute;rcio eletr&ocirc;nico.<\/p>\n<p> \tAtualmente, quase toda a receita do ICMS no varejo eletr&ocirc;nico fica nos Estados do Sul e Sudeste, principalmente S&atilde;o Paulo e Rio de Janeiro, sedes das empresas &quot;pontocom&quot;. Os demais Estados tentam participar do bolo, cobrando al&iacute;quota adicional de ICMS, o que est&aacute; sendo questionado na Justi&ccedil;a sob o argumento de bitributa&ccedil;&atilde;o.<\/p>\n<p> \tO com&eacute;rcio eletr&ocirc;nico n&atilde;o existia no Brasil quando a Constitui&ccedil;&atilde;o foi promulgada. Assim, ela disciplinou s&oacute; as formas tradicionais de venda, nas quais o ICMS deve ocorrer na origem quando o consumidor final estiver em outro Estado e n&atilde;o for contribuinte do imposto. A PEC apoiada pelo governo muda isso e determina que parte do ICMS incidente nas chamadas vendas n&atilde;o presenciais, como &eacute; o caso do com&eacute;rcio eletr&ocirc;nico, ficar&aacute; com o Estado de destino da mercadoria, na forma a ser definida pelo Senado. Enquanto isso n&atilde;o ocorrer, os Estados destinat&aacute;rios ficar&atilde;o com 70% da diferen&ccedil;a entre a al&iacute;quota interna e a interestadual do ICMS. &quot;Vamos aprovar a PEC ainda neste semestre&quot;, disse o senador Delc&iacute;dio do Amaral (PT-MS), presidente da Comiss&atilde;o de Assuntos Econ&ocirc;mico (CAE) do Senado.<\/p>\n<p> \tO faturamento do com&eacute;rcio eletr&ocirc;nico cresce em ritmo superior a 25% ao ano e chegou a R$ 18,7 bilh&otilde;es em 2011, segundo estimativa da e-bit. O n&uacute;mero de consumidores cresceu cerca de 9 milh&otilde;es em rela&ccedil;&atilde;o a 2010. Estados do Norte, Nordeste e Centro Oeste alegam perdas de receita. A Bahia diz que deixou de receber R$ 90 milh&otilde;es em 2010, antes de come&ccedil;ar a cobrar um adicional sobre essas opera&ccedil;&otilde;es. No Mato Grosso, a Fazenda calcula preju&iacute;zos de quase R$ 300 milh&otilde;es. No Piau&iacute;, impedido de cobrar o ICMS por liminar do STF, a Fazenda reclama de evas&atilde;o de R$ 140 milh&otilde;es por ano.
