O tribunal j\u00e1 decidiu que, pelo menos em um caso, eles n\u00e3o importavam. Esse caso, em que uma seguradora superestimou os lucros e um auditor aprovou seus livros cont\u00e1beis, levou a um processo de investidores contra o auditor que foi arquivado.
