{"id":11531,"date":"2022-12-13T18:00:47","date_gmt":"2022-12-13T18:00:47","guid":{"rendered":"https:\/\/alcantara.pro.br\/portal\/?p=11531"},"modified":"2023-11-14T18:50:09","modified_gmt":"2023-11-14T18:50:09","slug":"consif-questiona-norma-confaz-icms","status":"publish","type":"post","link":"https:\/\/alcantara.pro.br\/portal\/2022\/12\/13\/consif-questiona-norma-confaz-icms\/","title":{"rendered":"Consif questiona norma do Confaz sobre pagamento eletr\u00f4nico de ICMS"},"content":{"rendered":"<p style=\"text-align: right;\">Portal STF &#8211; Not\u00edcias<\/p>\n<blockquote>\n<p class=\"noticia-resumo m-b-24\"><em>Segundo a entidade, conv\u00eanio obriga institui\u00e7\u00f5es financeiras a fornecer dados protegidos por sigilo banc\u00e1rio.<\/em><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">O Conselho Nacional do Sistema Financeiro (Consif) ajuizou, no Supremo Tribunal Federal, uma A\u00e7\u00e3o Direta de Inconstitucionalidade (<a href=\"https:\/\/portal.stf.jus.br\/processos\/detalhe.asp?incidente=6523973\" target=\"_blank\" rel=\"noopener\"><strong>ADI 7276<\/strong><\/a>) contra dispositivos de conv\u00eanio do Conselho Nacional de Pol\u00edtica Fazend\u00e1ria (Confaz) que disp\u00f5e sobre o fornecimento de informa\u00e7\u00f5es pelos agentes financeiros aos fiscos estaduais nas opera\u00e7\u00f5es de recolhimento do ICMS por meios eletr\u00f4nicos. A a\u00e7\u00e3o foi distribu\u00edda \u00e0 ministra C\u00e1rmen L\u00facia.<\/p>\n<p style=\"text-align: justify;\"><b>Conv\u00eanio<\/b><\/p>\n<p style=\"text-align: justify;\">O conv\u00eanio <a href=\"https:\/\/www.confaz.fazenda.gov.br\/legislacao\/convenios\/2016\/CV134_16\" target=\"_blank\" rel=\"noopener\">Confaz\u2013ICMS 134\/16<\/a>, firmado entre os governos estaduais, integrantes do Confaz, estabelece que as institui\u00e7\u00f5es banc\u00e1rias passam a ter obriga\u00e7\u00e3o de informar todas as opera\u00e7\u00f5es realizadas por pessoas f\u00edsicas e jur\u00eddicas via Pix, cart\u00f5es de d\u00e9bito e de cr\u00e9dito e demais realizadas no pagamento do tributo por meio eletr\u00f4nico.<\/p>\n<p style=\"text-align: justify;\">De acordo com o Consif, a norma estaria, sob o pretexto de estabelecer obriga\u00e7\u00f5es acess\u00f3rias no processo de recolhimento do ICMS, exigindo que as institui\u00e7\u00f5es financeiras forne\u00e7am informa\u00e7\u00f5es de seus clientes protegidas pelo sigilo banc\u00e1rio.
