Entretanto, ainda incipiente \u00e9 a utiliza\u00e7\u00e3o da Escritura\u00e7\u00e3o Cont\u00e1bil Digital (ECD) como instrumento de auditoria cont\u00e1bil tribut\u00e1ria, importante instrumento para recupera\u00e7\u00e3o de tributos federais, estaduais e municipais, o que nos remete \u00e0s seguintes pondera\u00e7\u00f5es quanto a este cen\u00e1rio:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Apesar da exist\u00eancia de amplo e facilitado acesso das Administra\u00e7\u00f5es Tribut\u00e1rias estaduais e municipais ao reposit\u00f3rio nacional dos arquivos de ECD entregues, atrav\u00e9s do Sistema <em>ReceitaNetBX<\/em>, tal acesso ainda \u00e9 pouco explorado;<\/li>\n<li>A Receita Federal do Brasil compartilhou para todas as Administra\u00e7\u00f5es Tribut\u00e1rias estaduais e municipais o seu sistema aplicativo \u201c<em>Cont\u00e1gil Lite<\/em>\u201d de auditoria. Esta ferramenta permite amplas possibilidades de auditoria cont\u00e1bil a partir dos arquivos da ECD, contando ainda com recursos de cruzamento dos dados da ECD com os dados constantes nas EFD e Documentos Fiscais Eletr\u00f4nicos, al\u00e9m de outras importantes funcionalidades;<\/li>\n<li>A necessidade de revis\u00e3o da legisla\u00e7\u00e3o tribut\u00e1ria adequando-a \u00e0 realidade da ECD, do seu uso como meio de prova, e melhor capitula\u00e7\u00e3o dos casos de presun\u00e7\u00e3o de omiss\u00e3o de sa\u00edda considerando aspectos cont\u00e1beis da auditoria fiscal. Em algumas Unidades da Federa\u00e7\u00e3o e Munic\u00edpios os aspectos relacionados \u00e0 contabilidade s\u00e3o tratados de forma incipiente, enquanto em outros prevalece a clareza na sua abordagem.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Uma das grandes dificuldades enfrentadas na condu\u00e7\u00e3o da auditoria cont\u00e1bil tribut\u00e1ria s\u00e3o as diverg\u00eancias ou at\u00e9 mesmo omiss\u00e3o do registro das opera\u00e7\u00f5es banc\u00e1rias na escritura\u00e7\u00e3o cont\u00e1bil das empresas. Neste sentido o art. 6\u00ba da Complementar n\u00ba 105\/2001 garante que o acesso e uso de informa\u00e7\u00f5es referentes a opera\u00e7\u00f5es e servi\u00e7os das institui\u00e7\u00f5es financeiras e das entidades a elas equiparadas, ocorrer\u00e1 sem pr\u00e9via autoriza\u00e7\u00e3o judicial, desde que o contribuinte esteja sob a\u00e7\u00e3o fiscal. Este dispositivo j\u00e1 foi regulamentado no \u00e2mbito da Receita Federal do Brasil atrav\u00e9s do Decreto n\u00ba 3.724\/2001 e Portaria RFB n\u00ba 2.047\/2001. Ambos os diplomas legais foram julgados constitucionais pelo STF que, em seu julgamento, determina que para ter efic\u00e1cia em Estados e Munic\u00edpios existe a necessidade destes entes subnacionais editarem norma espec\u00edfica para regulamentar o citado artigo, o que j\u00e1 foi feito por alguns Estados e Munic\u00edpios.<\/p>\n<p style=\"text-align: justify;\">Esse livro apresenta uma extensa a colet\u00e2nea normativa municipal, fruto de ampla pesquisa sobre os aspectos que poderiam ser relevantes para a auditoria cont\u00e1bil tribut\u00e1ria nos munic\u00edpios brasileiros.
