\tA decisão do Supremo Tribunal Federal (STF) de proibir benefícios fiscais concedidos por seis estados e o Distrito Federal deverá acirrar as discussões da reforma tributária no Congresso Nacional. A avaliação é do secretário de Fazenda da Bahia e coordenador dos secretários do Conselho Nacional de Política Fazendária (Confaz), Carlos Martins.<\/span><\/span><\/p>\n

\t <\/p>\n

\tPara Martins, a decisão, por um lado, é importante para acelerar o fim da guerra fiscal – a competição entre os estados na concessão de benefícios a empresas para atrair investimentos. Ele, no entanto, acredita que os estados afetados exigirão mais garantias para as medidas de compensação de perdas, como a criação do fundo de desenvolvimento regional.<\/span><\/span><\/p>\n

\t <\/p>\n

\t“Prevejo uma discussão acalorada no Congresso Nacional porque os estados só aceitarão abrir mão dos incentivos fiscais se conseguirem assegurar alguma forma de compensação”, disse o secretário.<\/span><\/span><\/p>\n

\tDe acordo com a sentença do Supremo, os incentivos fiscais criados sem o aval das 27 unidades da Federação representadas no Confaz perdem a validade. A decisão anulou os benefícios concedidos por Distrito Federal, Espírito Santo, Mato Grosso do Sul, Pará, Paraná, Rio de Janeiro e São Paulo. “Na verdade, o Supremo não chegou a analisar o mérito dos benefícios. Apenas reconheceu o vício de origem, que foi o fato de eles não terem sido aprovados pelo Confaz”, explicou Martins.<\/span><\/span><\/p>\n

\t <\/p>\n

\tSegundo Martins, o Confaz ainda está analisando a decisão para avaliar o impacto sobre os estados. Os técnicos verificarão se o Supremo permitiu alguma regra de transição nos contratos atuais e se as empresas terão de ressarcir aos estados os descontos nos tributos pagos até agora. “É preciso ver se o fim dos benefícios só vale a partir de agora ou é retroativo”.<\/span><\/span><\/p>\n

\tO secretário afirmou ainda que o Confaz discutirá os encaminhamentos da decisão do Supremo na próxima reunião, em julho no Paraná. Ele não descarta que o conselho possa aprovar alguns benefícios declarados inconstitucionais, o que acabaria com a ilegalidade. No entanto, ele alertou que os estados prejudicados provavelmente precisarão remodelar os incentivos para conquistar o apoio dos demais secretários de Fazenda.<\/span><\/span><\/p>\n

\t“Do jeito que estavam, os benefícios não tinham a menor possibilidade de passar no Confaz. Agora, o conselho pode reavaliar a validade dos incentivos, desde que haja unanimidade dos membros”.<\/span><\/span><\/p>\n

\tO Confaz reúne os secretários de Fazenda dos 26 estados e do Distrito Federal. Qualquer decisão sobre concessão de incentivos só pode ser tomada por consenso.<\/span><\/span><\/p>\n
