\t\tA Receita Federal não pode, por autoridade própria, acessar os dados bancários dos contribuintes. Essa foi a decisão do Plenário do Supremo Tribunal Federal, no julgamento do RE 389.808, ocorrido em 15 de dezembro de 2010.<\/span><\/span><\/p>\n

\t\t <\/p>\n

\t\tA questão central do julgamento era a constitucionalidade da Lei Complementar 105\/2001, regulamentada pelo Decreto 3.724\/2001, que disciplina a quebra do sigilo bancário pela autoridade administrativa, tema que vem suscitando dúvidas e incertezas no Fisco e no contribuinte, já que o artigo 6° da mencionada lei permite à administração tributária o acesso aos documentos, registros e livros de instituições financeiras (desde que haja processo administrativo instaurado ou procedimento fiscal em curso, e as informações sejam reputadas imprescindíveis), mas os tribunais e o próprio STF têm proferido decisões contraditórias, ora entendendo indispensável a intervenção de autoridade judiciária no acesso aos dados, ora facultando ao Fisco o seu descortinamento direto.<\/span><\/span><\/p>\n

\t\t <\/p>\n

\t\tNo caso levado ao Plenário, após ter sido comunicada pela instituição financeira em que mantinha conta-corrente, da determinação da Receita Federal para que fossem entregues extratos e documentos pertinentes à sua movimentação bancária, a GVA Indústria e Comércio impetrou Mandado de Segurança visando impedir a remessa das informações. A ordem foi denegada pelo Tribunal Regional Federal da 4ª Região e a decisão foi desafiada por Recurso Extraordinário.<\/span><\/span><\/p>\n
